As if things weren't getting bad enough, Gunbroker just announced that starting Jan 1st, they will be collecting state tax on all transactions.

Everyone- eBay does it. The states are going to be hurting as they destroy small businesses. They'll scavenge every possible penny.

All online service providers and retailers are having to do this now.

It's no longer the old "you only have to collect sales tax if you have a physical presence in that state", like it was in years past.

There was a major supreme court decision on this a few years back, where they completely reversed themselves and allowed states to force out of state sellers to collect and remit sales tax from buyers in their states.

They quoted some law. I'm looking at a $1800 gun and the price just went up $108 after Jan 1, if I dont buy it by then. Not happy!

With some very minor exceptions you owed the same tax as an individual anyway. So there is no practical difference with respect to the SC ruling and the collection by the seller. At a legal level there is no difference.

In their e-mail to me, presumably because I'm such a faithful customer, they referenced "Marketplace Facilitator Internet Sales Tax" regulations.

I received the e-mail. It reads:

GunBroker.com will be implementing the new Marketplace Facilitator Internet Sales Tax regulations on January 1, 2021.

As a marketplace, GunBroker.com will be required to collect and remit sales tax on all sales according to the state law. State tax is calculated based on the ship to address of the order.

Let's hope gunbroker don't get into the pissing contest that several other vendors of mine are in with the revenue service in my State. The date of SC ruling is now years ago. The revenue service says you owe the collected taxes from that date (since use tax payments are a fraction), and the vendor says pound sand as we need time to implement this net result, no shipments.

I received the email as well - however, I don't live in a state that has the Marketplace Facilitator Internet Sales Tax law (for now). I wonder if they'll still charge a tax? That info wasn't in the FAQ

I am confused how person A can collect sales tax on person B selling something to person C?

I have a tax number/account to collect sales tax in my state. I think I will contact Gunbroker and tell them I have to collect sales tax from them on their auction listing fees.

I don't understand how everyone got so accepting of paying taxes on an item that already had taxes paid on it's original purchase, guns or otherwise. If you aren't a business registered in your state as a reseller, government can and should kindly fuck off regarding taxes.

Queue the guy that inevitably comes along to tell you to report and pay tax from your garage sale. Screw that.
It's our government. I want that crap fixed along with the election process or these elected officials will find themselves at the end of pointy objects.
