The only surprise I see here is that it was not done 3 weeks before the midterm elections, so that it would not have time to work it's way through the courts.


Federal judge blocks Trump's executive order requiring proof of citizenship for elections

Afederal judge on Friday blocked President Trump's executive order requiring proof of citizenship for elections.

Judge Denise J. Casper, of the U.S. District Court in Massachusetts, an Obama appointee, said U.S. states have a likelihood of success in their legal challenges to the order, The Associated Press reported.

“The Constitution does not grant the President any specific powers over elections,” Casper wrote in her ruling.

She also said that regarding citizenship, “There is no dispute (nor could there be) that U.S. citizenship is required to vote in federal elections and the federal voter registration forms require attestation of citizenship.”

Casper cited the states' arguments that the requirements would burden them with "significant efforts and substantial costs” to update procedures.

In April, the GOP-led House passed the Safeguard American Voter Eligibility (SAVE) Act again, which would require documentary proof of U.S. citizenship when registering to vote for federal elections.

Trump issued the executive order in March that includes the requirement that only U.S. citizens vote in federal elections, offers assistance to states with maintaining voter rolls, and makes improvements in the Election Assistance Commission.

The president also ordered the attorney general to prosecute election crimes, take action against states that accept absentee ballots for federal elections after Election Day, and ensure that foreign nationals do not donate to federal elections or that organizations that receive federal funds do not engage in lobbying.

The order additionally mentions the rescinding of "Bidenbucks" – the former Biden administration's apparent effort to have federal agencies partner with private groups in get-out-the-vote efforts.

In April, Democratic attorneys general in 19 states filed a lawsuit over the order, arguing against some of its aspects, including enforcing documentary proof of citizenship to register to vote and ensuring that states accept absentee ballots for federal elections after Election Day.

Vindman, who served as the Director of European Affairs for the United States National Security Council (NSC) under President Trump and then initiated that totally lame-ass first impeachment of Trump in 2019, melted down on X after U.S. Sen. Alex Padilla (D-CA), in civilian clothes on Thursday, rushed Noem’s podium during a press briefing. He was removed from the room and then handcuffed. He was released in time to play the victim on MSNBC.

Apparently then we can dispose of background checks to buy guns, and any licenses to possess or carry guns. We can each "attest" to being legally qualified to do so, without providing any proof.

Bars will stop needing to card people coming in the door to check they are age 21.

TSA will no longer have to see an ID or a boarding pass, and won't even have to screen passengers, everyone can just "attest" to being a passenger and not being any kind of miscreant.

This judge has set an interesting precedent.

President Donald J. Trump‘s bid for a rehearing of E. Jean Carroll‘s defamation case against him was rejected by the 2nd U.S. Circuit Court of Appeals on Friday. The 2023 lawsuit saw a $5 million jury verdict that held him liable for sexually assaulting and defaming the writer and alleged fabulist. Carroll accused Trump of raping her nearly 30 years ago, a claim he has consistently denied. She has also accused at least seven other men and boys of assaulting her in unrelated cases.

Two judges on the 2nd Circuit, Steven Menashi and Michael Park—both appointed by Trump during his first term—dissented from the court’s decision not to grant an en banc rehearing. In their written dissent, the judges criticized the panel’s ruling, stating it “sanctioned striking departures” from established legal precedent “to justify the irregular judgment in this case.

”President Trump’s last opportunity to contest the Carroll verdict now lies with the Supreme Court, though there is no automatic right for the appeal to be heard at that level.

“E. Jean Carroll is very pleased with today’s decision,” said Carroll’s attorney, Roberta Kaplan, following the ruling. She added: “Although President Trump continues to try every possible maneuver to challenge the findings of two separate juries, those efforts have failed. He remains liable for sexual assault and defamation.”
