Texas is suing Harris County officials for allocating more than $1.3 million in public money to legally defend illegal immigrants from deportation, Attorney General Ken Paxton announced on Tuesday.
The lawsuit, filed Monday in Harris County District Court, claims that state law prohibits local governments from spending taxpayer funds on civil actions, such as federal deportation proceedings.
“We must stop the left-wing radicals who are robbing Texans to prevent illegals from being deported by the Trump Administration,” Paxton said in a statement. “Beyond just being blatantly unconstitutional, this is evil and wicked.”

In the complaint, the state argues that immigrants who are subject to removal “have no constitutional or statutory right to government-appointed counsel” and must obtain legal counsel at no expense to the government, according to state law.

Commissioners voted 4-1 in October to approve the funds for the county’s Immigrant Legal Services Fund program, managed by its Housing and Community Development Department, to provide legal support to undocumented immigrants. The fund sends money to five organizations that help immigrants fight deportation.

The Texas constitution prohibits governmental entities like Harris County from using public funds as gifts or for private benefit to people and groups that do not serve a legitimate public purpose, according to the attorney general.

Hidalgo did not immediately return a request for comment about the lawsuit.

BTW, Hidalgo is the reason Texas got rid of having a circle on the election ballot allowing people to vote straight line demonrat or republican. The Republican and incumbent County Judge (i.e. in Texas one of really important tasks is they are the top person in the county for emergency management such as hurricane or pandemic) had a background in logistics, and had lead Houston's response and recovery from large hurricanes such as Ike. Straight line voting gave the 27 year old Hidalgo the election by 19,400 votes (~2.4 million registered voters in Harris County) despite zero experience. Of course Demonrats love firsts (e.g. first woman and first hispanic county judge for Harris County) and value that over qualifications. In other words, she is Harris County's AOC.
