Because the HOA owns it? My understanding of common areas is every residents gets to use it. In this case, only residents who are also pool members get to use the pool. Some residents are not pool members and are not allowed to use the pool. Is the pool then a common area or is there another term for it? Restricted common area or limited common area? My parents owned a condo in a 27 unit development. There we 9 docks available for purchase and 3 extra parking spaces per building available for purchase. Once purchased, they were owned buy the purchaser and yet managed by the condominium association. Management by the association didn't turn them into common areas. | |||

In my HOA there are pool members and non-pool members based on who purchased a pool bond. When my daughters were young they lived at the pool. We all had picture ID's and had to present them to get in. Given there was a gate attendant most of the summer there was never an issue of outsiders using the pool. My place in Florida does not have attendants at all pools but key code locks. There have occasionally been issues but they are under used so not a huge deal. | |||
