when I pointed out that a proposed law was unconstitutional to my State Legislator, he simply responded in a very harsh tone, "We don't know if it's unconstitutional until the courts say it is."

That has become the modern liberal approach. Violate the constitution at will and hope one of their liberal appointed judges abend the violation when it is challenged. Obama said as much on numerous occasions during his reign.
