CHICAGO — A man who fatally shot a would-be carjacker in downtown Chicago early Friday won’t be charged with any crime after police determined he acted in self-defense.

Chicago police tell the Chicago Tribune that an investigation revealed the 41-year-old man was a concealed carry license holder who drew his weapon and fired only after he was confronted with an armed man trying to steal his car.

The shooting happened early Friday. Police say the man was driving a BMW in the downtown area when his vehicle was rear ended. When the driver got out, he was confronted by a man who pulled out a gun, announced a carjacking and demanded the man’s keys. When the gunman pushed the man into the BMW, the man grabbed his weapon and shot the carjacker in the head.

A man who fatally shot a would-be carjacker in the Loop has been cleared through investigation and will not be charged with a crime, Chicago police said Sunday morning.

In a shooting around 3:15 a.m. on Friday, a 41-year-old concealed carry license holder drew his own weapon after being confronted with a gun near the intersection of State Street and Ida B. Wells Drive, police said. He was in his 2015 BMW when he was rear-ended by a 22-year-old man in a 2019 Volkswagen, according to officials.

When the man in the BMW got out to check the damage to his vehicle, police have said, the other driver pulled a weapon, announced a carjacking, demanded the man’s keys and shoved the man into the BMW, where he was able to retrieve his own gun from an area on the passenger side of the car and fatally shoot the man in the head.

“He was a concealed carry holder, so he was legally able to have that gun, and he was the victim,” said Officer Jessica Rocco, a spokeswoman for the Chicago Police Department.

The driver of the Volkswagen was taken to Northwestern Memorial Hospital, where he was pronounced dead. Police have said two weapons were recovered at the scene, supporting the BMW driver’s explanation of events.

Rocco added the shooting was determined to have been in self-defense.

Initially, the 41-year-old was questioned about the shooting of the 22-year-old to determine key details such as whether the pair knew each other prior to the shooting, said Anthony Guglielmi, a police spokesman.

“We have not found a link between the 41-year-old Chicago man and the offender, but we’re certainly looking at that to make sure that nothing could have precipitated this,” Guglielmi previously said while the investigation still was ongoing.

Detectives have since determined the BMW driver was justified in shooting his weapon. It remained unclear whether the car crash that led up to the shooting created a crime of opportunity for the would-be carjacker, or if it was part of an orchestrated plot to steal the BMW.

“Right now we can’t provide the motive, that part is still under investigation,” Rocco said, when asked whether the car accident was a ruse to make the driver of the BMW stop and get out of his car.

“We can’t confirm if that was the reason, or if it was just an accident,” she said.

Another police spokesman said authorities also can’t confirm whether the Volkswagen had been reported stolen or if it was registered to the man who was shot.

Shootings by concealed carry license holders are not tracked or monitored by any state agency, making it difficult to report statistics about how often shootings such as this one are determined to be justified. Unless law enforcement agencies voluntarily supply such information — which CPD often does — it can be difficult to get a clear picture of how many of the state’s residents have used their own concealed weapon to defend themselves.

Soooo much bullshit contained in the end of that article.
Police, during the investigation will find out if the shooter (and sometimes shoot-ee) has a concealed cary. As a matter of fact, ALL JURISDICTIONS in Ill do this. It’s not a secret. But the media around here is fuckin useless.

Haven’t heard anything about the VW yet, but won’t be surprised if it’s hot. Common tactic downtown/north side to do the “Bump & Run” where The bad guys use a stolen car to bump into the car in front of them, then get out and car jack it, or strong arm take it.

Kudos to the victim in this crime.
And the victim is the guy they attempted to Jack!

Yep, bump and rob. You will enjoy this story; a couple years ago I was with two other detectives in a white Jeep Cherokee with heavily tinited windows (no popo radio antenna) driving a crack ho around looking for a car jacker in his hood when she points out the guy as he drives past us (we were parked). Suspect does a u turn, pulls up behind us and bumps us. He jumps out of the car with his pistol, as we jump out with pistols and shorty shotgun. He drops his pistol and tries to take off running. He clips a curb and goes face first right into a wrought iron fence. And that is EXACTLY how it happened even though no one in the department believed us. Big Grin
