On top of the Montana Gun store raid, it appears that the left is now weaponizing alternative post purchase attacks on firearms owners. I'm a lifetime member of 2AF and get these updates on where they are filing suit to protect gun owner rights and stop the misdeeds of governments in the USA.

SAF SUES PENNSYLVANIA SHERIFF TO STOP WARRANTLESS SEARCHES

The Second Amendment Foundation today filed a challenge of Pennsylvania’s promulgated firearms regulation and its enforcement by the Pennsylvania State Police and Montgomery County Sheriff’s Office, which includes warrantless searches.

SAF is joined by Shot Tec, LLC and a private citizen, Grant Schmidt. They are represented by attorneys Joshua Prince and Dillon Harris, Civil Rights Defense Firm, of Bechtelsville, Pa. Defendants are Col. Christopher Paris, commissioner of the Pennsylvania State Police (PSP) and Montgomery County Sheriff Sean Kilkenny, in their official capacities. The action was filed in the Commonwealth Court of Pennsylvania.

The petition challenges Col. Paris and the PSP’s “interpretation, implementation and enforcement” of the firearms regulation “which is being enforced” by Kilkenny, according to the court filing. The petition alleges that Sheriff Kilkenny “has implemented a policy…which he contends, based on the PSP’s promulgation and implementation of (the regulation) permit him, in the absence of probable cause and a warrant and in violation of…the Pennsylvania Constitution, to come into those…homes or business.”

Plaintiffs further assert this inspection enables the sheriff to impose sanctions against holders of state licenses to sell firearms “for not having ‘safe storage’” in the event of an emergency when the PSP has “failed to promulgate any regulations addressing what constitute ‘safe storage’ or sufficient safeguards…when the General Assembly only delegated to the PSP the ability to establish such standards.”

“The State Assembly has never enacted a law allowing for warrantless searches of licensees, but the state police promulgated a regulation requiring licensees to submit to such searches, which are now planned by the sheriff’s department,” said SAF Executive Director Adam Kraut. “We believe there are grave constitutional issues involved in this scheme, particularly when an administrative agency simply waives an individual’s constitutional rights by implementing a regulation without any framework from the legislature. Equally troubling is the Sheriff’s assertion that he would revoke a license from and individual asserting their right to be free from unlawful searches and seizures. We have filed this petition to ensure constitutional rights are respected.”

SAF founder and Executive Vice President Alan M. Gottlieb observed, “No statute should allow carte blanche regulations to be imposed by any law enforcement agency because of the inherent danger of overstepping legal authority and constitutional protections which must be protected in a free society. We’re seeking a remedy from the court to stop this, especially when warrantless searches are involved.”

This new Montgomery County PA Sheriff (they are the ones in this state who grant our License To Carry Firearms, which is the PA CCW license) came in after the old and very good Sheriff retired and proudly stated something along the lines that he thought the state gave out too many carry permits and it was way too easy and he's going to make it harder.

One of his first moves IIRC in office was abolishing the whole same-day granting of a LTCF in Montgomery County if all your paperwork was in order and the background check came back good. Now it's a much longer process I think there. Luckily I'm in nearby Berks County and our Sheriff there is a good guy, clearly a conservative and supporter/defender of the right for Pennsylvanians to bear arms.

All of the old arguments of the left are crumbling and they are now openly in their preferred mode, brute force.

I'm never sure what irony is, but I'm pretty sure that it's ironic that all of the enforcement is against old guys in vests at a doughnut shop and they don't notice the tribal warfare down the street with bodies in the gutter EVERY DAMN NIGHT.

Confirmed, he's a Dem who hates the idea of us plebes owning and carrying guns:

As I stated before he's voiced his opinion more than once that he does not like the idea of private citizens being able to carry guns in PA and his goal was to make that harder. Now he's going to try and pull Gestapo shit on Montgomery county gun shops? Roll Eyes

Just once I want to see some prick like this get a hard lesson from the person he is violating. Then lose his job, pension, and freedom when his bruises heal. Just a liberal bully. Every moron that followed him in should get the same. Perhaps then we would see more law enforcement doing what is right instead of following some fool harassing a citizen because they’re afraid of losing their job. It’s crap like this many laid down their life to get away from. Just unbelievable.

Because it's about power and control, eliminating a political funding enemy, it's not about crime, murder, death, safety.

If it was then the approach in big cities like Chicago on shootings would be completely different.

Being a Chicago Cop, a few things:
Unless Chicago and other big cities just got kicked out of the United States, the Constitution, and the 4th Amendment still apply.

The SAF suing the Sheriff is laughable! If the sheriff is conducting warrantless searches, or giving orders to, in violation of the 4th Amendment, and his oath of office to uphold the Constitution, that fucking assclown needs to be arrested.

If you want to do something about the shootings in Chicago-
Build more prisons & make them a miserable place to be
Get rid of the liberal, "don't demonize the poor yute", "it's because of poverty" mayor
Launch the useless "too many black and brown in prison" States Attorney
Launch the useless "too many black and brown in prison" chief judge
Fire 3/4 + of the Illnois State Parole Board
Enforce the existing laws on the books.

But we're (Chicagoians) to fucking stupid to do important things like the listed above. WE KEEP RE-ELECTING THESE HALF-WITS!

There's no need to overlook, ignore and just plain "thumb your nose" at a document that is as important as the US Constitution.

400M is absolutely right. Until something drastically changes in certain places, and some of these assholes get put in check, this behavior will continue, and grow.

That appears to be the issue, He's doing what he wants, which is the work of the higher ups in the state party that passed the law, who are not going to do anything, since they like it, and we have federals DOJ who are also supporting the movement.

The only ones to stop him would be the IRS/ATF who might get upset he's stepping into their turf.

If I were a gun shop in Montgomery County and his goons started showing up to “inspect” my premises, I’d close up shop for the day. Send them away and when they come back, do it again and again and again. Family emergencies, burst pipe, doctor’s appointments, so sorry!
