Iraq war veteran Leonard Cottrell Jr. says that last month New Jersey police tried to confiscate his firearms without a warrant — and he did not let them take them. Two police officers visited his home "because his 13-year-old son had made a comment at school about the Millstone Middle School's security, and the officers wanted to confiscate Cottrell's firearms as part of an investigation," NJ.com reported. Cottrell, who legally owns a shotgun and a handgun, is a disabled U.S. Army veteran who served multiple tours during "Operation Iraqi Freedom." Cottrell says that his wife let the officers into their home and let them search their sons' room where they did not find any weapons but then the officers tried to take his firearms, which "he has all the correct permits to own." "No one from the state was going to take my firearms without due process," Cottrell said, according to NJ.com. The police's attempt to confiscate Cottrell's firearms comes after Democrat Governor Phil Murphy signed into law a bill that makes it easy for law enforcement to confiscate firearms without due process. Cottrell said that his son is upset by the situation and that he did not do anything wrong and the entire situation is being misconstrued and blown up. "He didn't do anything wrong, and he doesn't understand why it happened — he was just having a conversation with nothing as far as threats," Cottrell said. "It shouldn't have blown up the way it did. The article says the police "attempted to confiscate" the firearms. It doesn't sound like any violence was involved. So what exactly did the police do or say, and what did Cottrell do to counter? It sounds like it ended peaceably, thank goodness, but I would be interested to hear more what transpired. | |||

If the cops had "attempted" to confiscate, then the guns (a shotgun and a pistol, according to the God-awfully written article) would've been confiscated, over dead bodies if necessary. "May we please take your guns, just to make sure your son doesn't cause trouble with them?" is NOT confiscation, it's a polite request. Good grief! This isn't journalism. This is just bullshit. I don't think anyone needed to flap their yap. He has to have a Firearms Owner ID card to own the guns and a permit to purchase the pistol. They already knew he had guns. | |||

I interpreted (perhaps incorrectly) the story to say that the 13 year old son’s comments about school security made reference to his dad’s guns. It wouldn’t surprise me much if he did mention them. | |||

He has all the correct permits to own the firearms, he said, and predominately uses the shotgun to hunt. He said his wife allowed the officers to enter the home, and with her permission, they searched his son's room -- but they did not find any weapons, he said. The officers, he said, didn't have a warrant but still wanted to take his guns. Cottrell wouldn't let them. "No one from the state was going to take my firearms without due process," he said Thursday. He said the attempted seizure resulted because of a new law Gov. Phil Murphy signed into law that makes it easier for police to confiscate guns when someone in the state poses a threat to themselves or others. The law is part of a broader statewide effort to make New Jersey's gun laws even tougher amid the national outcry for more gun control in the wake of the school shooting in Parkland, Florida. The U.S. Secret Service said Thursday that schools around the country should establish teams to evaluate potential threats and encourage students to report troubling behavior. "Snitching is informing on someone for personal gain," the Secret Service said. But students should come forward "when they are worried about a friend who is struggling or when they are trying to keep someone from getting hurt." Cottrell said the officers "danced around the issue" when he confronted them about the new law. A New Jersey State Police spokesman declined to answer questions about whether this incident had anything to do with the new gun laws. In an email, Sgt. First Class Jeff Flynn said, "Troopers responded to Mr. Cottrell's residence in reference to the report of a possible school threat. Based on their investigation, it was determined that Mr. Cottrell's weapons did not need to be seized." Cottrell said he was able to work out a deal with the officers that he would remove the guns from his house and keep them outside until the investigation concluded. His son was not allowed to return to school and was barred from attending graduation, he said. Millstone school officials did not return a request for comment. "He's upset," Cottrell said of his son. That hurts. Given, it’s middle school but a big deal for most kids. This raises a number of questions. Most schools end in June. It’s now the middle of July. When did all this kerffule start? Then how does a vague “comment on school security” result in a police home visit? I’d expect a school resource officer would take the kid to the office, call homemade have a parent come in.
