Well I finally got the adjuster to return my call after having my agent poke him. His grand update.... The payout exceeds his authority to authorize and it's in his managers queue. Seemed very uninterested any information regarding comps for my Comp. Hopefully this doesn't turn into a battle. I'm prepared to be fucked, just hoping for a little lube.

medical as well, tho I was fortunate that I only had a few bruises and a bruised back, ,

Unfortunately this is the way you have to go, no attorney will take on property damage claims, there's no money in it. Plenty of attorneys that will take on ins companies at no cost to you....

You get the funds through the medical side of these policies.

You also need to file a diminished value claim since the car is rare.

Been there. My first Golf R had 277 miles when the flood hit. Still had temp tags.
Never thought I’d find another, but my VW guy worked the phones.
Keep your head up, Jesse. And keep looking.
You’ll find what you’re meant to find, soon.

I found my car 2027 M2 Xdrive. I'll order it as soon as insurance mess is done.

They made an offer that was reasonable, I was surprised. $89k+. I asked them to look at the four very reasonable comps (all in some minor way below mine. Millage/option/PPF/etc. I requested that they look at the four comps and bring the price up to between the highest and average price, because the condition dictates that. They said fine give us 24-48hr.

They call back after I've released the vehicle to them and tell me I have to pay $2000+ in uncovered storage fees. I text the owner and ask him to meet them in the middle or do whatever to make this go away. He agreed to negotiate with them.

His shop manager has to leave for family emergency but calls over and over today. Calls ignored. Adjuster calls and tells me that they refuse to negotiate and are rude, but the voice isn't the same. I text owner, he says that he gave him his mobile number to call while he drives to take care of family matters. Dumb ass adjuster calls the shop as he's on his way to family, they don't know about the situation, so they stick to normal operating procedures.

I text owner confirm everything, adjuster ghosts me over text, email, phone. This could literally be settled if he'd just answer his phone or call the right number.

Annoying.

Hopefully settled tomorrow.

Accident isn't your fault & you're on the hook for storage fees?

my wife is a paralegal, legal secretary, girlfriday, etc etc for a very very good domestics attorney

she walked down the hall and handed my case to another attorney,

she made a few calls, told the insurance to go pound sand, and got me the difference and then some,

Of course they are underinsured. I filed my claim against my insurance due to OEM replacement coverage and strong suspicion she was a 'state minimum' kind of gal. I was right. I should eventually get my deductible back from my company after they finish all claims.

Still no resolution on latest twist, but I have my agent now working what back channels she can. Ultimately even if she can't get it taken care of. I'm at $87k which is the exact OTD price for the new M2 Xdrive. I'll still have to buy accessories, PPF, tint, spare wheel/tire set and potentially extended warranty.

All things considered not as fucked as I was concerned with. I could almost treat my 22 months of ownership as a very expensive lease plan. Hopefully I'll get good news on Tuesday. Either lazy adjuster calls the body shop who is willing to compromise/negotiate OR my agents work pays off and they just pay the charges.

So here's the final verdict. Storage fees waived. $89.5k payout, hopefully recovery of $1,000 deductible in a few months. BMW order placed. The Audi payout covers BMW and carbon fiber M Sport rear deck lid/duck bill port install. Leaves $5.5k toward front lip, spare wheels/tires, tint and PPF, with me adding in about $5k or so for everything else. I'll delay the decision on any extended warranty after this ordeal.

I should get towards the $5k. $1k deductible, ~2k for sale of old wheel/tire setup, and $1-3k back on extended warranty. So best case scenario I swap a 2yr newer slightly less premium, but more raw fun car for $0.
