The Supreme Court announced Friday it will grant an expedited hearing on the Trump administration’s request to add a question concerning citizenship to the 2020 census.

The justices set oral argument for February, converting what had been a narrow request involving one part of the case into a full grant of review.

At stake is one of President Trump’s key goals — asking people to disclose their citizenship when they take part in the 2020 count.

Anti-Trump state attorneys general and immigrant-rights groups sued to stop the question, arguing it will scare immigrants, both legal and illegal, away from taking part in the census, skewing the count. That, they say, will mean some states won’t get the congressional representation nor federal money they are entitled to.

A federal judge in New York has ruled that asking the question isn’t inherently illegal — indeed, it was part of censuses up to 1950, and is still asked by the Census Bureau to some smaller sample sizes. But the judge questioned the motives of the Trump administration in asking it.

The case appears to come down to a parsing of words of Commerce Secretary Wilbur Ross, who said he made the decision to add a citizenship question, dismissing advice of some top aides, “solely” because of a request by the Justice Department.

He has since acknowledged also talking to a top White House official and others about the move even before the Justice Department request.

But government lawyers say his statement was accurate — it was the Justice Department request that he was responding to.

Solicitor General Noel Francisco said the case is a test of whether the courts will grant President Trump the assumption of regularity judges are supposed to give to an administration, not automatically assuming shenanigans or “bad faith.”

Immigrant-rights groups are wary of a loss at the high court.

“Census data is pivotal in the allocation of billions of dollars in federal funds and the apportionment of political representation, making the proposed citizenship question a critical issue for Latinos and all Americans,” said the National Association of Latino Elected and Appointed Officials.

How far will this decision go toward establishing a precedent in which congressional representation depends on citizenship, and how will it intern effect any future cases of birthright citizenship?

President Donald Trump said Saturday that he will present his written responses to questions from special counsel Robert Mueller next week.

Trump’s legal team has negotiated for months over what topics Trump will respond to and whether he is willing to take part in a sit-down interview with prosecutors.

“We haven’t even talked about it,” Trump said when asked if he is willing to have a face-to-face interview with Mueller’s team.

Trump’s lawyers have said that they are willing to let Trump respond to questions in writing about possible collusion between the Russian government and campaign. But they have asserted that questions about potential obstruction of justice regarding the firing of James Comey as FBI director are off limits.

Trump has insisted that he had the executive authority to fire Comey for any reason he saw fit.

Illegal aliens are not entitled to vote (even if some do illegally). However, they are represented in Congress in that congressional seats are apportioned according to population including illegal immigrants. I think that's wrong. It reduces the rights and power of citizens.
As a result, California gets more Congessional seats than it should and I am under-represented.

It also gives California more Electors in the Electoral College than it should have, and that is probably more disadvantageous.

Unfortunately, although I fully support the idea of only apportioning based on citizen population, I don't see any practical way to insure that end, short of requiring every person enumerated in the Census to show proof of citizenship--and we know that won't happen.

Sens. Dianne Feinstein and Kamala Harris, both members of the Judiciary Committee, called on the White House Monday to make a deal to fill court vacancies.

The two California senators asked Pat Cipollone, tapped to be the acting White House counsel in October, to broker a deal over three 9th Circuit Court of Appeals positions.

“While we continue to oppose the slate of nominees the White House put forward on October 10, we remain hopeful that you will work with us to reach a bipartisan agreement in a timely manner,” they wrote.

In exchange for agreeing to support the appointment of Judge James Rogan (who Trump picked), they want him to have Judge Lucy Koh nominated and confirmed for the Ninth Circuit Court of Appeals. She’s a District Judge for the Northern District of California who was appointed by Barack Obama at the request of Boxer and Feinstein

The easiest way to answer their request for a deal is to ask yourself - if the roles were reversed, would the dems let the republicans pick judges? They absolutely would not.

No support is needed from these two pieces of trash, and no deals should be made.

People wonder what will be the spark that sets off the Second War For Independence and I'll tell you it will be - the utter lawlessness and corruption of our government. NO ONE on the left has yet to be held accountable. FOR ANYTHING. Judges who make shit up as the go along, a DOJ that is rotten to the core, led by a weaselly tyrant and enforced by his lackeys in the FBI (also known as the enforcement arm of the DNC).

Trump better pick, and the senate better confirm, an AG who is willing to clean house.

President Trump has submitted his written answers to certain questions related to the Russia investigation to special counsel Robert Mueller, the president's legal team announced Tuesday.

Trump's personal lawyer Jay Sekulow said the answers were submitted on Tuesday and cover "issues regarding the Russia-related topics of the inquiry."

The submission caps off months of high-stakes wrangling between Mueller's team and the president's lawyers about what answers Trump would provide for investigators.

Trump's attorneys have long maintained they would only answer questions pertaining to allegations that the Trump campaign colluded with Russia's efforts to interfere in the 2016 election, and not inquiries about whether Trump obstructed the federal investigation into the interference.

Rudy Giuliani, another Trump lawyer, has repeatedly expressed fear that the president could walk into a perjury trap if he answers Mueller's questions about the firing of James Comey as FBI director and what he told the ex-lawman about the bureau's investigation of former national security adviser Michael Flynn.

"It has been our position from the outset that much of what has been asked raised serious constitutional issues and was beyond the scope of a legitimate inquiry," Giuliani said. "This remains our position today."

The former New York City mayor said Trump has "nonetheless provided unprecedented cooperation" to Mueller's office, including more than 30 witnesses and 1.4 million pages of material.
