Question: What is current French law about private ownership of firearms and their use, if any, in self-defense?

Answer: Private firearm ownership in France is tightly regulated as a privilege for specific purposes (mainly sport shooting, hunting, or collecting), not a general right, and self-defense is not a valid reason for acquiring or carrying firearms. Use of any weapon (including a legally owned firearm) in self-defense is possible only under strict conditions of légitime défense under the Penal Code.

Classification of Weapons

Weapons are classified into four categories under the Code de la sécurité intérieure (Internal Security Code), based on dangerousness. Rules for acquisition, possession, transport, and carrying differ by category. The official system is managed via the Système d'information sur les armes (SIA) online register for many holders.

  • Category A: Prohibited for private individuals (except rare, specific authorizations, e.g., certain competition shooters for limited items). Includes automatic weapons, war materials, certain high-capacity semi-automatics, camouflaged firearms, and specific dangerous items like certain knives or brass knuckles post-1900. Illegal possession carries heavy penalties (up to 5 years imprisonment and €75,000 fine).

  • Category B (authorization required): Primarily handguns (pistols, revolvers) and certain semi-automatic or other long guns. Acquisition and possession require prior prefectoral authorization (autorisation d’acquisition et de détention). Main legitimate purpose is sport shooting via the French Shooting Federation (FFTir). Requirements typically include being an adult (or limited cases for minors in competition), a valid shooting license, favorable federation opinion, medical certificate attesting physical/mental fitness, clean criminal record checks (no disqualifying convictions), and no entry on prohibition lists. Sport shooters face limits (currently up to 15 Category B firearms in total under recent rules). Storage in a secure safe is mandatory. Limited professional risk cases exist but are exceptional. Penalties for unauthorized possession are severe (up to 5 years and €75,000).

  • Category C (declaration required): Many hunting rifles, certain manual-action or limited-capacity semi-automatic long guns, higher-power air guns (≥20 joules), and some others (including certain alarm/signaling weapons). Requires a valid hunting permit or relevant sports shooting/ball-trap/biathlon license, plus declaration (typically handled via an authorized dealer and recorded in SIA). Must be an adult, meet background checks, and store securely.

  • Category D (free acquisition/possession for adults): Includes historical firearms (models pre-1900 or certain listed ones), black-powder reproductions without metallic cartridges, low-power air guns/paintball (2–20 joules), pepper/tear-gas sprays ≤100 ml, contact electric shockers, batons, and various knives/blades. No authorization or declaration needed for adults, but carrying/transport outside the home requires a legitimate reason (self-defense is not one). Transforming a Category D weapon can reclassify it and trigger higher penalties.

General eligibility rules apply across categories: minimum age 18 (with limited exceptions), no disqualifying criminal convictions, not subject to a weapons prohibition, and compatible physical/mental health. Private sales of B and C weapons generally must go through licensed dealers/brokers with registration. Inherited or found weapons must be regularized or surrendered within set periods. Carrying any firearm in public is broadly prohibited; transport (unloaded, secured) is allowed only for legitimate reasons such as going to a range or hunting ground.
Recent years have seen multiple regulatory tightenings (dozens of texts since 2007), including capacity limits, medical requirements, SIA registration expansion, and reclassifications (e.g., certain alarm weapons moved out of free Category D).

    Self-Defense (Légitime Défense)

Self-defense is governed by Article 122-5 of the Penal Code (and the related presumption in Article 122-6). It is a justification that can remove criminal liability for an otherwise prohibited act (including using force or a weapon), but it is assessed strictly by courts after the fact—it is not a blanket permission to arm oneself or use lethal force.

    Key cumulative conditions (Article 122-5):

  • Unjustified attack against oneself or another person (or, more restrictively, against property).

  • Immediate response (“dans le même temps”—at the same time as the attack; delayed retaliation does not qualify).

  • Necessary (the only reasonable means to stop the threat; fleeing or calling authorities may be relevant factors).

  • Proportionate (means of defense not disproportionate to the seriousness of the attack).

For defense of property alone, the bar is higher: the act must be strictly necessary, means proportionate, and it can never justify intentional homicide. Article 122-6 creates a presumption of legitimate defense for repelling a nighttime break-in (by force, ruse, or violence) into an inhabited place, or defending against violent theft/pillage—but this can be rebutted by evidence, and courts still examine the facts (necessity and proportionality).

Using a firearm: There is no general right to own or carry a firearm for self-defense. A legally owned firearm (e.g., a Category B or C weapon held for sport or hunting) may theoretically be used if all légitime défense conditions are met, but courts apply rigorous scrutiny to firearms, especially lethal force. Proportionality is critical—responding to an unarmed assault with a gun is often deemed disproportionate. The weapon must generally remain stored securely; retrieving and using it must still fit the immediacy requirement. Official guidance is clear that “self-defense” or preparedness for confrontation is not a legitimate motive for carrying or transporting Category D items (or higher categories) outside the home.

Penalties for illegal possession, unauthorized carrying, or improper use are substantial. In practice, successful claims involving lethal force with a firearm are rare and fact-specific; cases involving homeowners and intruders have produced varying outcomes depending on the evidence of necessity and proportionality.

To be honest, I actually believe this.

    quote:

Many people here ask why the military isn't deployed in France to stop the rioters.

Simple answer: Because there's a fear that they would side with the perpetrators.

    Why?
"The French army does not collect official statistics on the exact religious affiliation of its soldiers due to the strict French principle of laïcité (separation of state and religion).
However, estimates and reports from military chaplaincy services paint the following picture:

    Estimated Distribution of Religions

    • Muslim Soldiers: Estimates indicate that Muslims make up approximately 10% to 20% of the members of the French armed forces. This is a higher proportion than in France's overall population."

In reality, units near metropolitan areas are even more heavily infused with Muslims.

    Research it yourself.

Meanwhile US President Donald Trump had hours earlier blamed immigration for the disorder in France that saw a historic town hall torched, businesses ransacked and hundreds injured.

As chaos spread to Milan and Lisbon over the weekend, Mr Trump wrote on his Truth Social platform: 'France is burning!

'The immigration of people from an entirely different world, people with hatred in their hearts, has shattered that once great country.

'Close your Borders and take control, before it is too late!' …”

Amen. It’s already too late for France, but a good warning for other countries.

While France could deploy the military, the realty is the police has been told to not show-up or, to only take a soft-stand. France's police like Germany are on a tight leash, however if given the green light, they are given free rein when it comes to tactics and methods. Keep in mind groups like antifa, black bloc and other direct-action leftists were born in these cities, the police have experience with them and when the beatings and clubbings are allowed, things calm-down.

Germany is actively quelling the "protests".
Theres plenty of videos out show them punching, spraying and beating these fools.

I don't care what goes on in other countries around the world, but I'm very concerned about what's happening in this country. In 1952, Congress passed the McCarran-Walter Act. Banning Muslims from entering the US. The law is still on the books. Just think what history would be like had we enforced it!

We are tolerating it here in the U.S. Look at Michigan, Texas and NJ. Islam has taken root because of our tolerance, on the whole, and there is nothing stopping it.
I am glad we are deporting illegals, yet the legal ones who are here aren't Americans and will never call themselves Americans.

In their eyes they are living off the devil to kill the devil.

How do we combat this when our own politicians don't care? Thune on passing the Save Act? Bernie, AOC, Mitch, etc.

I did not know that. It sounds like we had it figured out, back in 1952. I think we had a lot of things figured out back then that we've forgotten or our character has simply become soft as individuals and therefore as a nation.

Yes. But we continue to do so. Why?

IMO, Islam is a false religion. Why do I say that? It's not because the people who practice it don't believe it. They do.

But I think Mohammad was a false prophet. He was a rapist and a brutal murderer. I believe he was the devil incarnate. The devil is the great deceiver. What better act of deception could there be than to create a false religion, one that millions of people would come to believe?

About every 800 years or so Christianity is faced with expelling or driving out the Muslims, or perishing. We called them the Crusades. We are due for another existential crusade.

The Immigration and Nationality Act of 1952 (The McCarran-Walter Act)

The Immigration and Nationality Act of 1952 upheld the national origins quota system established by the Immigration Act of 1924, reinforcing this controversial system of immigrant selection.

    https://history.state.gov/mile...1952/immigration-act

OK, I looked it up. It did NOT outright ban Muslims.
But it did greatly prefer Europeans who would assimilate by reserving most immigration for them.

National Origins Quotas: Maintained the controversial national origins quota system from 1924, reserving roughly 85% of annual visas for Northern and Western European immigrants based on 1920 population numbers.

At any rate, it was superseded by the 1965 Hart-Celler Act which later replaced these quota systems, which now is the law which affects modern U.S. immigration. Lyndon Johnson was a terrible president.

The misconception that the act banned Muslims often stems from a specific clause known as Section 212(f). This section gives the President sweeping authority to suspend the entry of "any class of aliens" deemed detrimental to the interests of the United States. Decades later, this specific 1952 statutory authority was cited by the Trump administration to legally justify Executive Order 13769 (commonly referred to as the "travel ban" or "Muslim ban"), which restricted travel from several Muslim-majority nations. However, the original 1952 text written by Congress did not mention or outlaw Islamic immigration.

a sprawling network of communist parties, revolutionary socialist groups, labor unions, Palestine-solidarity organizations and international media outlets working to transform grievances into a full-blown revolt against capitalism, government austerity and military spending.

Now, 28 communist and socialist youth organizations across 12 European countries are mobilizing for a coordinated November 20 strike under the slogan "Fight for Our Future, Not Their Wars," calling for walkouts, blockades, occupations and mass demonstrations.

Among the international amplifiers: organizations tied to Neville Roy Singham, a Marxist tech tycoon living in Shanghai, whose network includes Tricontinental and BreakThrough News, a New York-based outlet that published advance coverage of the weekend's mayhem in France.
