Do the feds issue a waiver for schools with armed staff? How do the avoid compliance with the fed law?

SEC. 1702. GUN·FREE SCHOOL ZONES ACT OF 1990
quote:
(A) It shall be unlawful for any individual knowingly to possess a firearm at a place that the individual knows, or has reasonable cause to believe, is a school zone.
(B) Subparagraph (A) shall not apply to the possession of a firearm -
(i) on private property not part of school grounds;
(ii) if the individual possessing the firearm is licensed to do so by the State in which the school zone is located or a political subdivision of the State, and the law of the State or political subdivision requires that, before an individual obtain such a license, the law enforcement authorities of the State or political subdivision verify that the individual is qualified under law to receive the license;

As long as the laws of your State comply with Subparagraph (B), and do not prohibit possession of a firearm in a school zone, anyone with a CCW Permit/License is exempted. State Laws count here, but Constitutional Carry won't cut it. Here in NH you could even Open Carry in a school w/ a NH Pistol/Revolver License...It would be legal, but I wouldn't recommend it though.

I thought the federal law was gutted and pretty much unenforceable? No? At any rate federal laws are not enforced by local cops and I have never seen a federal law enforcement officer near a school enforcing federal laws. If anything, it could be used as a charging enhancement for someone that is already arrested for something else.

I work at a school and carry a gun everyday as part of my duties. Florida law allows it (Coach Aaron Feis law)

^^ Historically I've seen people Open Carry at the polls in a school on Election Day here. That said, sometimes just because you can, doesn't mean you should. Wink

Polling places are on the short list of prohibited places here in gun friendly Florida.

it's federal law but locally enforced, I simply cannot see it being enforced by any police agency whos jurisdiction overlapped where people would vote to arm teachers. The optics of making those voters children less safe in those voters eyes would be political suicide for any mayor or sheriff.

I posted the pertinent part of the Federal Statute that 'truly answers the question', at least as it was stated. 'As long as the laws of your State comply with Subparagraph (B), and do not prohibit possession of a firearm in a school zone, anyone with a CCW Permit/License is exempted', therefore NO waiver would be required, not that one could be issued anyway. Any exemptions, to ANY law, would be part of the statute.

If that doesn't answer your question, then you need to be more specific!
