Adverse possession is possible but normally takes years to accomplish. When courts look at adverse possession claims, they apply a four-factor test. Humans learn by experiencing consequence. I suspect these knuckleheads made it this far in their stupidity by avoiding, displacing an/or denying consequence. Their appeal to remain in the structure they had no business improving is another effort to avoid consequence. If allowed to continue these people will eventually do something really destructive. These weren't stupid people, they followed a well laid out path. They were devious and conniving not driven by some innocent desire to make things right. The only successful Adverse Possession cases I've seen myself are ones between country folk who started mowing, grazing, fire abating, and otherwise maintaining a portion of an adjacent property that no one had visited (besides the neighbors) in many years. Fences get moved, the pasture got enlarged, the weeds taken care of, and poof, 20yrs later Bob successfully takes ownership of 100ft of the East side of Bill's Grandmother's empty farm. This sort of thing came up in Oil & Gas leases and title research from time to time. | |||

I actually agree with the couple. There is a Mercedes a few doors down the street that hasn't been driven for a couple of days. I wiped off the windshield and the rims, and now the car should be mine. I don't understand the mindset of the couple. Do they know their claim is nonsense and think they can get away with it? Gloucestermen, did you forget the link to the article, or did I just miss it? Their claim of adverse possession surely wouldn't fly in Idaho: LINK It takes 20 years to establish adverse possession in Idaho, and in addition to the issues that you listed, they'd also have to show that they had paid the property taxes for those 20 years. Adverse Possession sometimes gets to be an issue around here, too. That's because when cowboys built fences back in the 1880s, they often didn't have the benefit of a surveyor to help them, and/or they used the natural contours of the land to establish the fence lines. Now, when a parcel gets sold, if the new buyer is foolish enough not to have a survey done, he tends to think the fence lines are his boundaries. Then, when he discovers that's not so, an adverse possession assertion gets made. The issue is always settled conclusively at the county assessor's office. If you can show that you've paid the taxes on the property in question, then it's your property. Thanks, Sap | |||
