About time that rule making authority was stripped from regulatory agencies. In my previous career I was in the environmental business as a hazwaz consultant. It was less about the environment and more about the money that could be squeezed out of people over trivial errors in documentation. The EPA never worked in good faith with a single client. If you actually managed to clean up a site, the EPA lost a revenue stream. They didn’t want that to happen.

- Trump is a damned liar - I'M NOT TIRED OF WINNING YET!! Razz

- Vague language does not confer specific regulatory authority (already known, but man did that ever need to be reinforced - and enforced)

- If Congress had the opportunity to address the matter and passed, agencies cannot simply address the matter as they please

- "Transformative" policies have to be explicitly OK'd by Congress at one level or another

- Congress is going to actually have to take responsibility - if it can get the votes together - for whatever pie-in-the-sky bullshit the extremists in the electorate want

- God willing, this may be another nail (or two, I'll take as many as I can get) in the coffin of technocracy in the US

- Presidential elections could become slightly less of a matter of life or death (but judidial appointments will always matter)

As reported earlier — In a 6-3 Ruling, the Court has decided that the Clean Air Act is no longer an appropriate vehicle for the EPA to curtail greenhouse gas emissions from power plants. The ruling sides with conservative lawmakers, states, and the fossil fuel industry to reduce the impact and authority of the EPA. The move is a win for the nation’s energy production, and limits the ability of Biden to stop or end fossil fuel production by the United States oil industry.

Justice Elena Kagan, a committed leftist and crackpot, warned in her dissent that the Eastern United States could be “swallowed by the ocean” due to global warming.

The ruling (long) does not forbid regulating carbon emissions. It put the responsibility where it belongs - on the Congress!

Basically, it tells Congress t do the job it is elected to perform. Congress can specifically and in clear terms, delegate the responsibility to the EPA.

I took the time to read the entire opinion as well as Kagan's rebuttal. Brain fade, especially with Kagan.
