c1steveHer trial started on Monday, two days ago. Some persons should not be police officers, as they are not calm under pressure. I suspect this is the underlying problem, and she should spend many years in prison IMO.
If anyone on this forum was sitting on a couch in an apartment, and eating a bowl of vanilla ice cream, they would be a bit slow and hesitant to react if a stranger walked into the apartment commanded them at gunpoint. I agree that with her LEO training she is the last person that should make such a stupid mistake.

hbablerI haven’t seen anything about alcohol . It’s interesting that they charged her with murder. Furthermore I’ve heard that they can’t reduce it to manslaughter. Do any of our legal eagles have insight on that?

I think that in Texas you can shoot an intruder in your house at night whether they are in the process of attacking you. Their presence is a threat. But I need to brush up on the Texas Penal code. If true, and if it happened to be her home, she could be justified by law in shooting an intruder whether a cop or homeowner.
Given she wasn’t in her home, mistake or not, means she’s cooked even if I’m mostly correct on the law in Texas.

I'm not familiar with Texas law so I'm extrapolating a bit here: When charging her they could have charged murder and manslaughter (a lesser included offense) but doing so would give the jury an easy compromise, so they charged only murder as an all-or-nothing tactic. Maybe they want to hammer her or maybe they want to give her a chance of getting off entirely--we'll never know.
Double jeopardy attaches once the jury is impaneled so once that happened they couldn't add a charge manslaughter.

c1steveThe sexting is something here defense attorneys come up with. Prosecution was able to show that her relationship with the other LEO was finished two months prior, and that there was no sexting. However after the shooting, she texted her ex-BF.

limblessbiffThey did the same thing with the ray tensing case here in Cincinnati. Charged him with murder and nothing else and he got 2 mistrials

patwI can't think of a reason that would justify what she did and her statement of being tired. At her age, I worked 60 hours straight with no sleep (worked in ems and a large hardware store). I was tired and beat but I knew where I was and what I was doing. Even now I sometimes work 48 hours straight, as do my other brothers and sisters and no one has had a problem. If she can't handle a regular shift, she doesn't need to be in a position she is in, let alone be able to have a firearm.

c1steveShe could be ADHD. When she gets excited, her reasoning goes out the window. Or she just cannot handle stress. Either way Amber never should have been a PO. Ms. Guyger should do her 15 years in jail, and be glad it was not her that was killed.
We could have a poll, if it was you or your wife/child/husband that was killed, how many years would be a reasonable sentence for Amber?

The problem is that due to what appears to be politically motivated pandering manslaughter is not on the table. Only murder.
