Employers who abuse this should be fined for each day that the H1B worker is employed. Jail time would be nice. Fraudulent H1B workers should be deported immediately. הרחפת שלי מלאה בצלופחים | |||

That’s what drives me nuts about the tax the rich all the time. If we still have fraud, waste and abuse and I don’t want to hear about a single penny more from anyone for that matter. | |||

They are fined, and companies know that, and even factor that into how they do business. Here's a simplified version: Let's say Company X wants to hire some undocumented or fraudulent workers. They get some associates at arms length to start a staffing company called ABC Staffing, and Company X contracts with ABC Staffing for contract workers, filling the slots with less than legal workers. The workers rock along for a few years doing work for Company X until the scheme is uncovered. "Oh dear" says Company X, "We were assured that ABC Staffing was only employing legal workers... In fact, it's a requirement of our contract!" ABC Staffing gets fined a few hundred thousand dollars, loses the contract, declares bankruptcy, and closes up shop. Company X continues with business as usual, since shortly afterwards there's a new player in town, DEF Staffing. And wouldn't you know it, Company X contracts with them for workers. They rock along for a few years until another investigation, after which Company X says: "Oh no, Mr. Investigator, you say they were employing illegal workers too?! We had no idea, we swear." DEF Staffing pays a fine, loses the contract, and folds. Company X rolls on. Cue the arrival of GHI Staffing... Company X gets to keep enjoying the profits gained from this illegal labor, while their fall guy staffing companies keep taking the heat from the few and far between investigations (limited investigatory resources and all), with Company X retaining plausible deniability and avoiding consequences whenever there does happen to be an investigation. Very, very common in the manufacturing/poultry processing/agriculture industries, those hard, nasty, labor intensive factory and field jobs that others balk at but illegal workers are willing to do. | |||
