I believe that Kerry's action is against the Logan's Act. I am pretty sure he did not have any authorization from Trump. If you or I did this, we would be charged. God Bless Smile

The Logan Act (1 Stat. 613, 18 U.S.C. § 953, enacted January 30, 1799) is a United States federal law that criminalizes negotiation by unauthorized persons with foreign governments having a dispute with the United States. The intent behind the Act is to prevent unauthorized negotiations from undermining the government's position.[2] The Act was passed following George Logan's unauthorized negotiations with France in 1798, and was signed into law by President John Adams on January 30, 1799. The Act was last amended in 1994, changing the penalty for violation from "fined $5,000" to "fined under this title"; this appears to be the only amendment to the Act.[2] Violation of the Logan Act is a felony.

Only two people have ever been indicted on charges of violating the Act,[3] one in 1802 and the other in 1852.[4] Neither was convicted of violating the Act.[4]

Oh, go on. Kerry's an old man, let's go ahead and give him the chance to claim that he was at least first at something.

Sidenote on Kerry. Didn't he buy a $7 Million yacht, custom built in New Zealand, and docked it in RI, to save $500K in Mass taxes?

I know many have a short memory, but it was barely a year ago that the left was accusing Donald Trump Jr. of violating the Logan Act when he met with the Russian lawyer. Like I have said over and over again, whenever the left is throwing out accusations, they are neck deep themselves.

That is an absolute truism. And nothing will happen to Kerry. He operates with the full power and consent of the swamp. And he will be shielded by their enforcement arm, the DOJ/FBI.

Boston Globe has an article on Kerry negotiations with the Iranians, and they state that it is not a violation of the Logan Act.

So I guess it is settled law. Roll Eyes

I was just going to say that. Seems like it wasn’t so long ago the left was crying about the Logan act say, late 2016. Correct me if I’m wrong, but Trump’s tenure still has a way to go.

I heard Dershowitz talking about this this morning.

Apparently the Logan Act is considered "dead letter" (had to look it up). In other words, it will never be enforced, John Kerry or not. If it were not "dead letter", he would definitely be guilty.

Kerry’s shadow diplomacy therefore toughened Tehran’s hard line and its the conviction that Trump in his weakened political position at home would not risk pulling the US out of the nuclear accord.

How does anyone know what Kerry is talking about with this guy? He has no negotiating posture, no power to actually accomplish anything. He may explain some of it as he understood it, remind the Iranians what provisions mean, etc.

As I understand it, negotiations are over with. The deal is signed, although not ratified by the Senate as our law requires. As it is, it is merely an understanding between the President and someone else. Kery thinks everything he does is rife with world changing ramifications, but he has never been as important as he thinks he is. Even his mom didn’t think he was that important!

Luckily, I have enough willpower to control the driving ambition that rages within me.

When you had the votes, we did things your way. Now, we have the votes and you will be doing things our way. This lesson in political reality from Lyndon B. Johnson

"Some things are apparent. Where government moves in, community retreats, civil society disintegrates and our ability to control our own destiny atrophies. The result is: families under siege; war in the streets; unapologetic expropriation of property; the precipitous decline of the rule of law; the rapid rise of corruption; the loss of civility and the triumph of deceit. The result is a debased, debauched culture which finds moral depravity entertaining and virtue contemptible." - Justice Janice Rogers Brown

Perhaps we could crowd source a "dossier"?

The deal here is the hypocrisy of the Democrats.
Let's go back to a previous ABC News article from Feb. 2017.

Even though Flynn is out, Democrats and critics are calling for investigations and question whether he violated the Logan Act, a law dating back to 1799, which prohibits unauthorized individuals from communicating with foreign governments.

House Democrats on the Oversight and Government Reform committee Monday sent a letter to chairman Rep. Jason Chaffetz, R-Utah, asking him to reconsider launching an investigation into Flynn and his ties to Russia.
