Hello everyone. I want to list a few pistols in the classified section and was wondering if any of the experienced sellers here can tell me what I need to do after the sell. What is the proper and right way to send the pistol to the buyer. I do not have a FFL license so I was wondering what I am allowed to do. Thanks for helping. Herbert Meier Jr. | ||

Concerning shipping, the easiest method would be to find a local FFL who'd ship on your behalf. Expect to pay $30 to $50 for this. Trying to ship a firearm yourself via FedEx or UPS overnight is probably going to run you $75 or more. Not to mention having to go to a "hub" to drop off and ship. There's also an online service called shipmygun.com for which I personally have no experience with but I've seen firearms shipped to my employer using this service. ----------------------------------------------- What's the sense in working hard if you never get to play? | |||

You need a copy of the FFL's license that the buyer will take delivery of the gun from. You cannot ship to an individual. With this copy you can ship UPS or Fedex to the FFL but it must go overnight air which is very expensive. If you have your FFL ship it, he can us USPS which is much cheaper but he will charge you a fee. How much depends on your relationship with him. Depending on value, you should have it insured. | |||

Greetings Herb (and everyone). Selling a firearm is really fairly simple, at least if you want to make it that way. In my experience I use a few of my own rules. 1. I make the transfer FFL to FFL only This transfers all future liability to the licensed FFL’ers - they do it for a business, I don’t. It costs me $25 to transfer and the actual shipping cost, so, depending on weapon, maybe $40 total. Insurance is optional and the buyer has to pay for that. Make your ad state whether you pay for shipping or buyer does, 2. I (my FFL) do not ship to California, Hawaii or Alaska. Too prohibitive either legally or money. 3. Other states also have restrictions, magazines, or th weapon itself, so make it known your FFL won’t ship to some states/locales and buyer should know what is acceptable. 4. Post an “UNCONDITIONAL I’ll take it” in the thread gets the item. I know there are a few other things to consider, and I may come back to edit this post, but others will pick up on those things too. An FFL is not allowed to send copies of an FFL (just the FFL number) to an individual, although some will do anyhow. If you are shipping yourself by UPS or FedEX go to ATF's website & verify the FFL by the number you received. Print the verification & keep it in your files. As many have said, usually having an FFL ship is best. As to required overnight shipping being required, that is subject to many opinions & most manufacturers ship 2 Day Air. Also you may find overnight or 2 Day Air is not an option. Nashville is the hub for parts of KY & AL & the only method available is Ground. Can you point to an ATF rule that says it is prohibited (i.e, not allowed)? I find it hard to believe that there's such a rule, and the dealers just ignore it. Not some dealers, but many will give it to individuals. You'd think they wouldn't want to jeopardize their career by ignoring an ATF rule, if one exists. ![]() Q | |||

Herbie, not sure if anyone above mentioned this but all the rules they have listed are for shipping a gun out of your state. If you sold it to someone in your state of Arkansas then it is most likely entirely different and much easier.... My Native American Name: "Runs with Scissors" | |||

I have been told this twice by dealers when shipping firearm. Maybe I misspoke & it may not be an ATF rule, but it seems I did look it up. The point is that an individual does not need a copy of the FFL to ship to that FFL. Use E-Z Check -- A private individual does not necessarily have to have a copy of the dealer's FFL to ship to him. Some dealers will not want to send you a signed copy of their FFL. That's a legitimate concern for them, as they may not want copies floating around that could be used to make fraudulent purchases at gun shows or other dealer's premises. However, they should be willing to tell you their 15-digit FFL license number. You can then go to the ATF's online FFL E-Z Check system at www.atfonline.gov/fflezcheck. Enter the FFL number, and the site will show you the dealer's name ane the address of their licensed premise. ^^^^ I know about the ATF EZ Check, and non-FFL parties don't have to have the FFL copy. That has nothing to do with what you said originally about the dealer "not allowed" to give his FFL copy to non-FFL individuals. When you said that, it automatically registered to me that there is an ATF rule somewhere that I've missed all these years. ![]() Oh, and I've known some dealers pulling that "not allowed" BS on me. Funny thing is, one time, they emailed a copy of their FFL. Then, a few hours later, another person from the same outfit emailed me and said ATF doesn't allow them to do it. I didn't want to embarrass that person by telling her I already got a copy. Q | |||

Its a good idea to post clear photos. Don't use Photobucket to host the pics. Use another service like Postimage.org. This will help your sale go smoother and let potential buyers see what you are offering. Not to pick on you: Using an FFL to make the transfer on your end is probably the most convenient way to handle it, and could also be cheaper. The FFL can use the US Mail, which is cheaper, and not having to deal with UPS or FedEx over a gun saves some effort. Also, you don't have to worry about having the receiving FFL's license, or any odd laws in the receiving state. But it doesn't absolve you of any liability. If you comply with the law (primarily by making sure you have the purchaser's FFL's license, and shipping it to the FFL directly) there will be no liability. If you have done something else that was improper (like knowingly selling a stolen gun), using the FFL won't get you off the hook. Again, using an FFL will be more convenient, and if you aren't sure how to comply with the law, then you may avoid accidentally making an illegal transfer. But that isn't the same as "transferring liability." The fish is mute, expressionless. The fish doesn't think because the fish knows everything. | |||

There is a delay with the ATF updating the ATF FFL eZ Check. It is good to be aware of the fact that it is not updated on a daily or even monthly basis.
