A New Mexico lawyer this week petitioned a state court to be the personal representative of the estate of Halyna Hutchins, a procedural requirement in pursuing a wrongful death lawsuit in the case of the Rust cinematographer who was killed in October in on-set shooting of a prop gun being held by Baldwin, the film’s star and producer.

The petition, sent Wednesday by Santa Fe attorney Kristina Martinez to the 1st Judicial District Court of Santa Fe County, was filed “solely for the purpose of investigating and pursuing a lawsuit under the New Mexico Wrongful Death Act in the courts of New Mexico.”

The letter (read it here) said Hutchins’ two “surviving immediate family members,” husband Matthew Hutchins and their son Aldous Hutchins, both support the petition, which said that “any proceeds from a wrongful death case will be distributed pursuant to the personal representative’s fiduciary duty in accordance with the Wrongful Death Act.”

New Mexico law provides a three-year window for filing a wrongful death action.

In November, Matthew Hutchins hired Los Angeles-based law firm Panish Shea Boyle Ravipudi, which specializes in personal injury and wrongful death litigation.

In addition to Baldwin, a call sheet for the day of the shooting obtained by The Associated Press lists five producers, four executive producers, a line producer and a co-producer. They, as well as assistant director Dave Halls and armorer Hannah Gutierrez, could all face some sort of liability even if they weren’t on location Thursday.

The payouts — which could be covered in part by insurance held by the production company, Rust Movie Productions — would likely be in the “millions and millions” of dollars.

[Editor’s Note: Media outlet TMZ reported that Rust Movie Productions’ liability insurance limits total $6 million. According to the certificate of insurance written by Front Row Insurance Brokers, general liability coverage is limited to $1 million per occurrence. There is also a commercial umbrella policy for an additional $5 million. The insurer is Chubb National.]

“There was clearly negligence on the set,” said Adam Winkler, a professor at the UCLA School of Law and a gun policy expert. “The producers had a duty to preserve the safety of the crew. There were obvious hazards on the set.”

I disagree. If anyone is reading about us at all, it's likely it'll be in the study of how we fell as a nation, as we read about the end of Rome and other empires. In the event of an industrial workplace accident it is generally true that workman's comp would cover it. In Indiana if you accept workman's comp you give up the right to sue. If you refuse workman's comp I think you can sue for gross negligence.

There are long established procedures to make industrial equipment safe to do maintenance and other work - lock-out/tag-out which many hear may be familiar with. But people fail to follow it and injuries do occur, even deaths. But there is a precept - every individual working on a piece of equipment is responsible to ensure that it is safe and and locked out and NOT rely on anyone else to do it for them. So if you get hurt, ultimately it is because you failed to ensure your safety. Now if someone cuts a lock off without permission and fires up the machine and it hurts/kills someone that's a different story.

So in this case, it follows that everyone in the chain of custody of the firearm was responsible to ensure that it was safe and not rely on the armorer, assistant director, or anyone else.

But I do think that there is a reasonable claim of gross negligence here. The armorer was incompetent, no one checked to make sure the gun did not have live rounds, and they were using it for target practice with live rounds off hours shortly before hand.

And like Para, anything against Baldwin is fair game here. Let the courts sort it out, and let him pay for his defense.

It's now approaching four months after the event. If they have probable cause for an arrest (of Baldwin or anyone else involved), what are they waiting for. If they don't have probably cause, where is new evidence / testimony going to come from now?

I'm thinking at this point there won't be a criminal case. The civil cases will be settled for the insurance money.

Brian Panish, the attorney representing the family of Halyna Hutchins, announced during a press conference in downtown L.A. on Tuesday that a wrongful death suit has been filed in New Mexico against Alec Baldwin and “others responsible for the safety on set and whose reckless behavior” led to the “senseless and tragic death” of the cinematographer on the Rust film set.

Lawyers for the family of Halyna Hutchins announced the lawsuit filed in New Mexico in the name of Hutchins’ husband, Matthew Hutchins, and their son, Andros, at a Los Angeles news conference.

At least three other lawsuits have been filed over the shooting, but this is the first directly tied to one of the two people shot.

Is that actually what happened? Shit - for some reason I thought he was rehearsing/dry firing the scene. That can't be what happened, is it? What motivation would anyone have for doing that.(albeit a prop gun). Even a blank at that range could be damaging.

If a scene required drawing the revolver, cocking the hammer, pointing the gun at a specific target, and pulling the trigger, why couldn’t that have been rehearsal for the act? Dry fire training with handguns often involves something similar. (Yes, of course, there is the safety issue of pointing the gun at a person, but that doesn’t change the fact that the actor was engaged in what he considered to be legitimate rehearsal activity with an unloaded revolver.)

There’s no reason why a rehearsal of the act would have involved firing a blank.

And according to Nick Searcy, rehearsals are usually performed with a literal prop gun, meaning a plastic or rubber gun. A real firearm is typically never provided unless the scene is actually being shot. And then all the safety protocols are in place.
