Why is he allowed to "resign" instead of being fired? This cop should be facing charges instead of collecting $70,000 of taxpayer money. This is why public unions should be illegal, no accountability.

What a dick.....question for the LEOs, what is the law on this? If I am doing yard work and a cop decides he doesn't think I belong there do I have to show him ID?

The dude should have just gone in the apartment....but I get why he is pissed off

It probably depends on the state. I know if I am on my own property, they are not getting my personal info without a warrant, or at least some communication that I am suspected of committing a crime.

Officers need reasonable suspicion to detain and not probable cause or proof beyond a reasonable doubt. The officer has to be able to articulate his reasonable suspicion to detain for belief of an offense. Even so, the officer doesn't have to explain his reasonable suspicion to the person being detained...unless it is an agency policy.

Yep, or the officers can lie for the reason for the detention. Even so, detention is reasonably temporary. There are so many court cases on this it isn't funny.

Technically, yes.

Now, as soon as the situation is safe (no commotion, no ill tempered fools yelling and screaming, all people accounted for and all weapons accounted for and people patted down) I'll be happy to tell you exactly the reason...

But most fools are too busy arguing to even listen to the explanation.


Now, back on topic, I can't really fathom what the reasoning is to detain this guy. Seems pretty dumb.

Here is how I "detained" most people:
"Can I talk to you for a second"?
98% of people said OK. Even criminals.
Those that didnt, I just let go. Or already had enough reasonable, articulable suspicion to press on.
And the cop in this incident was way out of line.
And on a lot of these types of complaints or calls, I resolved them by just watching what was going before I opted to contact anyone. Simple observation. Cutting edge investigative technique!

This is how I worked too...it’s so much easier that way. I worked in an inner city jungle, and this attitude got me thru my day without much trouble.part of Being a cop is being naturally curious and investigating, but being able to talk to people is a invaluable tool.

One of my "can I talk to you for second" detainments went all the way through the courts up to the state supreme court.
Affirmed every time.

So when the officer shows up at your house to take your stolen yard elf report and that officer asks for your info for the report your going to tell him/her to get a warrant? Right........

I'd say there's a big difference between you calling the police for a legitimate reason and just having one meander on up for no legitimate reason at all.

And he probably has union protection and a contract that makes firing him harder than the effort they want to put into it.

Yep. Not true in Arkansas. Here, continuing in later LE employment with a different agency has to do with whether you retain you certification by the state law enforcement commission, not whether you were fired vs. resigned.

So someone could be fired and potentially still retain their LE certification (depending on the circumstances), which means they could go work for another agency.

And someone could resign but potentially be decertified by the commission (depending on the circumstances), which means they can't go work for another agency.

I may well have acted like that kid as well. He told him that he lived there and was picking up trash around his place. That is all the investigation necessary. I would have been livid. I probably would have told the asshole to arrest me on suspicion of trespassing or let me go. Never mentioned anything about the owner (or anyone) asking the kid to leave the property. If the property owner has not asked the kid to be removed can a cop do so, especially with no evidence that there was any crime being committed?
