New Liberal 'online harms' bill to make online hate punishable up to life in prison

Bill C-63 aims to force social-media, user-uploaded adult content and live-streaming services to reduce exposure to online content deemed harmful, to strengthen the reporting of child pornography and to better address hate propaganda and provide recourse to victims of hate online.

It also amends the Criminal Code to create a new standalone hate crime offence that would allow penalties up to life imprisonment to deter hateful conduct, as well as raise the maximum punishments for hate propaganda offences from five years to life imprisonment for advocating genocide.

Harmful content is defined in the legislation as content that incites violence, that foments hatred, that incites violent extremism or terrorism, is used to bully a child, that sexually victimizes a child, that induces a child to harm themselves, or intimate content communicated without consent.

The bill also creates a new Digital Safety Commission, which will be responsible for enforcing rules and holding online services accountable, as well as a separate Digital Safety Ombudsperson, which will support and advocate for users and make recommendations to social media services and the government.

If they really want to protect children, focus ONLY on that issue.

They are pecking away at the second amendment. They’ve weakened our ability to defend our rights. Though they’ve lost some ground they hoped to take, they’ll never stop trying. We all know to defeat an opponent, attack him at his strongest point. When that point falls, the rest of the defense falls soon after. Ketanji Brown Jackson Concerned First Amendment ‘Hamstringing the Government’

U.S. Supreme Court Justice Ketanji Brown Jackson said Monday that she was concerned that the First Amendment was “hamstringing the government in significant ways, in the most important time periods.”

Jackson addressed Louisiana Solicitor General Benjamin Aguiñaga, whose state joined Missouri in suing the federal government over its attempts to censor speech on social media platforms during the coronavirus pandemic, ostensibly for public health reasons.

Jackson had earlier presented a hypothetical situation in which social media platforms were allowing a dangerous trend to circulate in which children were encouraged to jump out of windows “at increasing elevations.” She asked whether government authorities could not “encourage social media platforms to take down the information that is instigating this problem.”

Aguiñaga suggested that the government could use the “bully pulpit” to push back against the content of the information, but could not call the social media platforms to encourage them, or coerce them, to take down the information.

Jackson objected, saying that it was not enough to say that the government could post its own speech. There were situations, she suggested, in which the government could “encourage or require this kind of censorship” necessary for public safety.

Conservatives have objected to the White House calling on social media companies to suppress information — such as skepticism about vaccines, or political speech about election integrity.

The case is Murthy v. Missouri, No. 23A243, in the Supreme Court of the United States.

Ketanji Brown Jackson is obviously one of those people unclear on the concept of the Bill of Rights and that “hamstringing the federal government “ is exactly the intent of them.

^^^^^^^^If I had 15 minutes with either of them, I could show them they believe it.

To some extent it's been happening here with law enforcement and the FBI TYR program in conjunction with Amazons Tech departments ReKognition programs.

Software like this was likely used in the J6 investigations to find people in the crowd to arrest.

Justice Department discloses FBI project with Amazon Rekognition tool

The disclosure comes after Amazon said in 2020 that it would institute a moratorium on police use of Rekognition.

The Department of Justice has disclosed that the FBI is in the “initiation” phase of using Amazon Rekognition, an image and video analysis software that has sparked controversy for its facial recognition capabilities, according to an update to the agency’s AI inventory.

In response to questions from FedScoop, neither Amazon nor the DOJ clarified whether the FBI had access to or is using facial recognition technology, specifically, through this work. But the disclosure is notable, given that Amazon had previously announced a moratorium on police use of Rekognition.

An AI inventory released on the DOJ website discloses that the FBI has a project named “Amazon Rekognition – AWS – Project Tyr.” The description does not mention the term “facial recognition” but states that the agency is working on customizing the tool to “review and identify items containing nudity, weapons, explosives, and other identifying information.”
