Actually, the fact that LEOs aren't restricted should be the basis for overturning both the magazine restrictions and handgun registry in CA.

The problem with the analysis is that only states that are more generally anti-gun will have such a statute and their circuits may also be likely to uphold. so there won't be circuits that strike down these bans. In other words, it isn't so much that there isn't a split, but that circuits that would go the other way won't get a case.

And that the circuits are divided isn't the only reason the Supremes can take a case. It is a good one, but not the only reason.

And note that cert was denied in the 1st Circuit case just a couple of years ago.

Not many of us will flame you for saying that. In fact I’d bet your opinion is shared by the majority on this forum including most LE.


I think next time that pResident Potato runs off at the mouth about evil assault weapons, Someone should ask if he’ll lead the fight by executive fiat to order his USSS detail to get rid of all their LCM, assault weapons and the rest of the weapons of war that have no place on the streets of America.
