I used to prosecute traffic tickets as an intern during law school and this came up from time to time. Each preggers mom who tried it lost because: 1. HOV or carpool lanes require the occupants to be separate and distinct people sitting in the car by themselves, and 2. Your child needs to be in a state approved car seat. A womb or test tube doesn't count. Whenever you saw a preggers lady with the glimmer in her eye you knew it was coming and the look upon conviction was equally precious. | |||

You're right. The law can't have it both ways. Either a 34 week fetus is a living being or it isn't. So if you're going to make the argument it's a living being in abortion arguments, you have to also agree that it's a living being in this case. | |||

The problem with flashlight boy's example of the car seat requirement is that would open the door for a pregnant woman to be ticketed for transporting a child not in an approved car seat. How could the law possibly hold the position that a car seat is required for a living child passenger in an HOV lane but not outside of it? I can also imagine a scenario where someone responsible for vehicular homicide involving a pregnant women could be charged with two counts. | |||

Threaddrift: We have both the enclosed & the 'express' (double white line) lanes here in Houston. The enclosed HOV I've never had a problem with & have used to avoid traffic in/out of downtown. The express lanes are more of a non-enforced suggestion & I see often used a passing lanes. Cars freely just merge in/out of it as they please, as if it was just another lane of traffic. Indeed! That we are even having this conversation is further evidence our society has become increasingly overburdened with legislative minutia. HOV lanes were conceived (pardon the pun) by state's representatives as a ruse to demonstrate to their leftist constituency they were doing something meaningful for the environment. I'm surprised the antiquated HOV lane concept has not evolved into a No SUV Lane or an Electric Vehicles Only lane scheme. | |||

It's not that all bad of a case for. Perhaps a good test case or at least a clarification of the law. Nothing wrong with a legitimate challenge of the the law. If they can make a bazillian genders, sexes and whatever out of nothing this is not all that crazy. I don't care one way or another but it does deserve a look, IMO. | |||

HOV lanes in the DC area are also 'express lanes' that you can travel with your EZPass. And it is all about the revenue. Pre-EZPass, there were a half dozen state and county cops along the side of 66 hoping to catch those unfortunate drivers who started on the road when it was open, but God help you if the clock strikes midnight and you are 500m from the end of the HOV zone. But now with EZPass, there are cameras all over the place. I am rooting for the woman because she found a loophole, and I hate it when law enforcement is focused on getting fines.
