So if they pay incomes taxes in their home state and income taxes in NY, they end up being penalized for helping in a crisis. In fact, even if they just paid NY income taxes, they are likely to end up with less take home pay, so they are penalized either way. Brilliant move by Pierced Nipples. They will get a tax credit on their resident State return for some or all of the tax they paid to NY. Problem is if you don't have a home resident State filing, i.e. TX worker paying tax to NY. And, either way, a PITA and costly to file a NY return. And, then their are City taxes in many NY cities which may or may not apply. We're talking about people that volunteered to go there and in many cases get paid 3x-4x their normal pay rate, plus lodging provided... AFAIK, taxation by other states is defined by reciprocity agreements between states. For Virginia, this is: Virginia has reciprocity with several other states. This allows Virginia residents who have a limited presence in those states to be taxed only by Virginia. Likewise, residents of the other states who have a limited presence in Virginia are taxed only by their home states. States that have reciprocity with Virginia are: - District of Columbia - Kentucky - Maryland - Pennsylvania - West Virginia If you meet the reciprocity criteria, you are exempt from filing requirements and income tax in your state of non-residence. Link As an example, my wife works in Maryland (her physical office) but is only taxed by Virginia. A friend of mine does proposal work for various companies across several states every year. He pays taxes to those states where he physically accomplished the work. IIRC, some time ago DC thought it would be a good idea to tax non-residents commuting into and working within the District. I believe pro sports players have to file state income tax returns for every state they play a game in, if that state has state income taxes. I would agree that "volunteers" from out of state, getting paid from their out of state employers, working in NY, should pay NY state income tax, IFF (IF, and ONLY IF) the State of NY reimburses those out of state employers IN FULL for the salaries/wages and benefits of those volunteers. Otherwise Governor Cuomo, well, er, uh . . . . I might suggest the underlying motivation is not fairness or compliance with the law. Rather, it is totally monetary. Perhaps the motivation is to get news traction, and pressure Trump and the Feds for more money. As to wages earned in NY, fine, but it also says they want to tax the income during that time they earn at home. So if you are still paid by your employer in Utah, and you work in NY and are paid by a NY employer (which is probably the case) then both your original employer and NY employer wages will be taxed in NY... It's about getting more money for the state since NY, CA, et al are having a case of the shorts... | |||

Any affected person who voluntarily files a return for NY is a FOOL. And yeah, I'm very familiar with the law and I don't give a wet shit what it says. I'm certain all the politicians that travel all over the place are absolutely meticulous with keeping track, filing and paying in all the various jurisdictions they park their no-good ass in. It's funny how people will defend the Federal and State Governments to their last breath as that last breath is being strangled out of them by same. | |||

It's OK, they are just nailing to coffin shut on anyone going out of their way to help NYC the next time. They had the entire country backing them on 9/12/2001, and somehow in less than 20 years they pissed away an entire country's good will. The Wall Street bailouts of 2008 didn't help their image, and now people will fight tooth and nail to prevent any state level bailout that allows NY to keep buying votes with taxpayer dollars. | |||
