OKLAHOMA CITY, Okla. (KOKH) — According to an open letter released by the ATF in 2011, Oklahoma gun owners may have to choose between their guns or a medical marijuana license.

Oklahoma made history on Tuesday night by become the 30th state to legalize medical marijuana, but a Federal law may keep some Oklahomans from getting their license.

Tyler Miller said there are no excuses when it comes to the federal form required to fill out to purchase a gun. The general manager of Wilshire Gun said they handle all applications the same way.

"When we call them, we ask the questions and have you convey answers on that documentation on that form that goes up and that's it," Miller said. "Those questions are very clear on there."

According to a Federal law, any person who is "an unlawful user of or addicted to any controlled substance" is prohibited from shipping, transporting, receiving or possessing firearms or ammunition.

"Basically you can't have one and can't get one," Miller said. "If you're a felon. If you have a misdemeanor for domestic violence."

It's something that could be confusing to Oklahomans, where marijuana will soon be legal for medical purposes in the state.

"Even if your municipality, your state has legalized for medicinal or recreational purposes marijuana, it does not preclude you from answering 'no' on that question," Miller said. "It does not discount it."

For now, Miller isn't seeing major changes for his store.

"It's not going to impact us I don't think," Miller said. "Not in any great detail."

Marijuana is listed as a Scheduled I controlled substance.

The ATF say it doesn't matter if a state has passed legislation authorizing marijuana use for medical purposes, it's still against Federal law.



Personally, Never used the stuff. I am tentatively for legalization, provided we can come up with some sort of test for telling if one is going up or coming down from a high. AKA Blood alcohol test/ Breathalizer.

Given that, this underscores the need to change the federal law prior to any grand sweeping states rights change.

an article like this comes up every time a state or municipality legalizes MJ,

folks, at least in the media, don't get that is a State Law,, but to buy the firearm you have to fill out a Federal Form (4473)..

you would think after the 30th state has legalized some form of MJ, the Feds would get a clue,

but then again, as a controlled substance, it would still be treated like any other controlled substance on the list (from 11.e on the 4473)

Oh look, this issue again. Let’s play this finger-wagging game every time another state legalizes it at any level and pretend like it isn’t the dumbest part of the 4473. Let’s do this a few times a year for the next five or ten years. Seems like fun.

Staggering double standard and just another way to screw over good people. Maybe they should edit the 4473 to include casual alcohol use too. Monks are the only people that should be allowed to arm themselves. /Sarcasm

The kicker here is it functionally only effects medical MJ users, because they usually have to get some sort of state trackable credentials. In states that allow recreational MJ, while they may check IDs for age, AFAIK, they don't record IDs and send them to a central database. So those users can lie on their 4473, and no one will know.

AFAIK users of legally prescribed opioid pain medications can legally buy guns. Now we can debate the legitimacy of the concept of medical MJ, but it seems inconsistent to allow one and not the other.

They already use blood test to check levels of THC in suspected DWI/DUI operators. I vaguely remember that the DA's had a particular number of units per liter of blood that was their brightline for intoxication (like 0.08BAC for alcohol). I charged a few people for DWI wile high on MJ, but they were not the norm...I think I charged four or five in 18years....

Alcohol is LEGAL, pot is ILLEGAL. You think people who consume alcohol shouldn't own guns? Make alcohol illegal. You want to smoke pot and own guns? Make pot legal. Saying "oh the 4473 should ask if you drink too" is stupid. It't not illegal! Why would they ask if you used a legal substance? Do you want them to make you list your legal medications too, prescribed and OTC? "I used sudafed yesterday. Can I buy a gun"?

This is not difficult.

probably from a poor definition of 'Controlled Substance'

since the 4473 has no instructions for 11.e (and 11.g) the rest of the question have an instruction on the back of the form,

and some states are ABC states,, Alcohol Beverage Control,, guessing some folks read the Control and think controlled substance,


just a guess, and I have had buyers ask if by controlled do they mean how much I drink,,,

And then every time someone tries to bring up legalizing pot, it's the end of the world because Cheech is gonna murder babies for dope money, and the streets will run red with blood after the dopers, high looking for the bag of Cheetos they dropped on the floor, crash into the good Christians on their way to church. It will literally be the end of all civilization. Literally.

Why should you have to choose? Guns and weed are both excellent, sure they don’t mix well but you shouldn’t have to choose one or the other. I thought this was the land of the free and the home of the whopper.
