Well, it may have been a sting, but I think it was just a prohibited buyer. I have a few guns on Armslist. Don't need the cash, just slowly getting out of Glocks and/or .40 and freeing up space in the safe. Yesterday a guy texted me from a local phone #, asked if I'd come down from $500 to $400 for a beater Glock 23. I agreed. But I was out on appts and didn't have it with me. I told him I could meet after 8pm, got home, texted him when and where I could meet. Radio silence. Today he texted me that he had dozed off, still wanted it. I said same place in 30 min. No reply for an hour. By then my phone had exploded I got busy with work and I was going to meet a guy for a very, very good trade on another gun I had on there. That trade went off perfectly, totally cool guy, scored an amazing deal. Finally met the Glock buyer at my range. He had FL plates, so I said I had to ask for an AZ ID. He said he was picking it up for his brother, who's an AZ resident. I said no AZ ID, no deal. He said he had a passport. WTF? Then he said he had his FL DL with him, but that he was an AZ resident. I said, "So you're an AZ resident with FL plates and a FL DL? You're gonna have a problem if pulled over. No deal." He insisted his brother was an AZ resident. I said, "You will go to jail over this and I'm walking." He gave me a real scowl. Five min. later I was on the phone with Mrs. Lee about dinner plans and missed a call from a 407 (Orlando) area code. Then he texted, asked if I was still there. I just replied, "No deal." Then I called my bandmate, who's Phoenix PD. He said he'd put me in touch with the right person. I told him this guy or these guys are going to buy a gun this weekend. I don't know why, but they will get one. I'm waiting for a call from the right dept. at Phoenix PD. | ||

Better safe than sorry. The state of CA protects me by making all my private sales and buys go through an FFL and buyer waits 10 days. I had a gun for sale on a local board and guy reaaaallly wanted it with no FFL involved. Not today ATF/CADOJ... | |||

Though there's no wait in AZ, all the guns in Fast and Furious went through FFLs too. That may have protected the gun stores involved, but it certainly didn't mean the sales were kosher. | |||

Yeah, best to bail on that one, no AZ license, unreliable. I just bought on Armslist a few days ago, 22 rifle the son was eyeballing. The seller preferred a CC license, many do. We met early afternoon at Walmart, all went most excellent. | |||

Is there a law that you have to ask for his license or can't sell to a non-Arizona resident? What was illegal about the sale? Under Fed law it is illegal to private transfer a firearm including handguns, rifles and shotguns to a person that resides in another state this includes family. Edited to add most states also have laws against it. It's stupid but it's the law. The law is that you have to be a resident of the state so asking for a state issued id is the norm. Seeing the out of state plates was a clue and not being able to verify AZ residency was the deal breaker. Possibly, but there isn't enough information. The potential buyer didn't make or even attempt to make the case that he was residing in Arizona. Bringing up that his brother is an Arizona resident is irrelevant. Rick Lee did the right thing and I would have done the same. I'm a resident of Florida. I also live in Michigan for 2 1/2 months each year. I maintain a home in Michigan, pay property taxes, utilities etc. I've bought long guns in Michigan while residing in Michigan. I haven't purchased hand guns because Michigan requires a permit to purchase handguns and it just isn't worth the hassle to figure out for me. State laws obviously need to be complied with as well. From the ATF FAQ about unlicensed persons: "May a person who resides in one State and owns property in another State purchase a firearm in either State? If a person maintains a home in 2 States and resides in both States for certain periods of the year, he or she may, during the period of time the person actually resides in a particular State, purchase a firearm in that State. However, simply owning property in another State does not alone qualify the person to purchase a firearm in that State. [27 CFR 478.11]" | |||
