Ordered a BP revolver from a well-known online gun shop only to be informed that "serialized firearms are to be delivered only to FFL dealers". Spent a good hour on the phone trying to explain first to the CS rep and then to her supevisor that black powder revolvers are not firearms in the eye of the Federal and state laws (both in my and their state). No luck: "If it is serialized it is a firearm!". Had to cancell the order. I've bought a good number of firearms from them over the years but they won't see a single red cent from me going forward.

You can't be too upset at them. You obviously don't mind if anybody else buys from them since you won't say who they are.

It's their company policy I suspect not their ignorance... their lawyers probably think that if the BP revolver goes through an FFL then that reduces their liability when a person does something stupid or illegal with it.... to a degree.

the obvious question is they ship it to an FFL for a 'transfer' to you, does the FFL do a background check on you to receive the BP gun?

Is it one that can be converted to center fire with the addition of an aftermarket cylinder?

Because it is plainly stated in their policy that so-equipped arms are not directly shipped to customers.

I don't think that matters in the technically legal part of it with shipping a cap and ball gun... now if it did have the conversion cylinder on it, then that is a whole different gun... and I'm pretty sure has to go through an FFL if an out of state sale.

The background check wouldn't bother me one bit...it's the $40 fee that I'd have to pay for it that would piss me off, on a purchase where its not legally required.

I had a Civil War BP revolver left on the front walk by the USPS who also refused to get a signature although it was sent priority mail/signature required.

When I spoke with the ATF about this they informed me that they do not consider BP to be "guns" and thus the rules pertaining to FFL, signatures. etc. do not apply.

But I agree, it's probably their policy. F them - there are too many other options to buy a BP gun from and have it shipped direct to you than to have to deal with Buds policy.

One of our local stores had a new BP rifle for sale. Only one they have ever had there. A red sign attached said that a 4473 was required to purchase.

Sometimes it is just a malformed and misinformed policy that can piss you off.
Had a situation with a large online Gun place that is local to me that gave me a hard time because my DL did not have Dr. appended to the street and I did on my 4473, even though this is easily checked and I have always used both interchangeably (Dr or not) for 40 years.
I cancelled the order and went back a few weeks later (price was better).
So never say never when it's just the mindless doing stupid things.
Intentional misconduct is another thing ~ like Black Rifle Coffee. Mad

It only becomes a firearm if (and when) converted. But in this particular case there were no conversion cylinder even bought along with the revolver, let alone installed in it. And it's not like I never bought online a cap&ball revolver, just not from this vendor. Always delivered right to my door.

Bud's is facing enough lawsuits currently, so they are probably being extra careful... I did just order from them yesterday with no issues. Well, other than how long it takes to get my order to my FFL.

Is it possible they would just give it to you, presumably sans 4473 and a fee?
Maybe a call to your FFL could answer these questions?

Actually, the OP made an effort to adhere to forum policy.

It seems to me that Bud's is much like Palmettos State Armory in the sense that they've grown so much and they are so very busy, the quality of service has suffered noticeably.

A 4473 and transfer thru an FFL is required for cap and ball guns that can readily be converted to fire modern ammunition. As far as I know, the only model like that right now is the Ruger Old Army, but there may be others. Ruger even had to start putting serial numbers on the Old Army, which is now out of production. I've dealt with several irate customers on this issue by showing them a copy of the ATF circular, which has been out quite some time. This may not apply to your purchase, but it may be of interest. Bud's was sold a couple of years back, and customer service has suffered greatly. I live close to them, but rarely even go there anymore except for the indoor range.

This is probably what would happen, but I just didn't feel like playing along with the idiocy. It's like being told there are 47 genders - I can't just nod to that.

Interesting. The revo in quesiont is old Colt design. But Uberti serializes everything now anyway.
