As I recall, he did the shooting.

That said, fuck him!

Give him adult penalties now that he is an adult.

I tell you that at 17 I knew full well the consequences of my actions and he was just short of being 18 anyway.

To paraphrase Dirty Harry - he does it because he likes it.

The Supreme Court ruling that is being referenced in this case was about "mandatory" life sentences for convicted offenders under 18.

Justice Elena Kagan referred to state laws that “mandated each juvenile (convicted of murder) die in prison even if the judge or jury would have thought that his youth and…the nature of his crime made a lesser sentence (for example, life with the possibility of parole) more appropriate.”

“We therefore hold that mandatory life without parole for those under age of 18 at the time of their crime violates the 8th Amendment’s prohibition on cruel and unusual punishments,” she said. Justices Anthony M. Kennedy, Ruth Bader Ginsburg, Stephen G. Breyer and Sonia Sotomayor agreed.

If the states of Virginia and Maryland review the Malvo cases, they can determine that a life sentence for Malvo is appropriate. They just have to look at the crimes and consider the fact that Malvo was under 18 during the sentencing.

Sure, but first Virginia needs a law allowing that. Don't know about Maryland.

For Virginia pre-1995 cases, 40 years need to be served prior to being eligible for parole. The SOB is in his early 30s now. So, consecutive sentences should keep him nice and warm and out of Dunkin Donuts.

Manson got the death penalty and then:

1972

Furman v. Georgia 408 U.S. 238: Court ruled that the death penalty, as applied, was an arbitrary punishment and thus unconstitutional under the 8th and 14th Amendments.

Everyone on death row got spared the death penalty.So Manson has been fed,clothed,had medical care and recreation for 45 years since the Supreme court gave him a reprieve.
