Screwed up FFL situation Login/Join

So I recently finally found a 617 Mountain Gun. Bought paid for and shipped to a local FFL that I have transferred many many times through.

This time I fill out the form but am told they are locked out of the FDLE(?) system. I give them a week and call. They are still locked out of whatever system he is referring to.

Not trying to be a tool but what are my options?

Simple answer would be have him transfer it to another store, but FDLE looks like Florida's answer to NICS and there's a chance the whole system is down, and that helps no one.

Google and Faceplant say no FDLE outages since November 2020. Call another FFL and ask if they can handle it as DanH suggested.

That’s strange, it’s true sometimes an FFL can be locked out due to system issues but those are typically quickly resolved.

Overall, IMO, the FDLE system has been getting worse each year.

Considering the impact that has to be having on their ability to conduct business, you'd think they'd be on the phone calling whoever they can get ahold of to get that fixed immediately. If it was my business, I wouldn't put the phone down until it was fixed. A week is crazy.

I agree with the others...have them get that gun to another shop that can do the transfer.

Yep I’m thinking I need to get it transferred someplace else. I know it’s there because he let me shoot it when I did the paperwork, I just couldn’t transfer it. Ugh.

I now have my speed beez loading blocks and speed loaders. I need this to be done. lol

I got locked out my NICS account as soon as I tried to log in to do a check. It said I had to change my password, which can be a pain. I just called it in by phone and it worked. Now I always log in to make sure I can a few hours before I do a transfer.

BTW, I got a delay on a guy on Thurs. for a $3700 FN SCAR. If that comes back as a deny, I wonder how much I can buy it from him for. I'm not going out of pocket to ship it back and the seller would charge a hefty restocking fee too.

Nevada background system got hacked and was down for weeks. I had a gun sitting at bass pro I couldn’t pick up.

Motivated me to get my Concealed carry license.

Is this an actual business, or just a kitchen table dealer?

If it's an actual business, they would be hemmoraging money not being able to do transfers for over a week, so there's clearly way more to the story.

If it's a kitchen table dealer, it's possible that he's just not motivated to fix it quickly and is dragging his feet because he can't be bothered, or it could be something more insidious.

So what's the real story here? Did the store/dealer lose the gun, or sell it out from under you, or damage it while finger-fucking it and are waiting for it to be fixed, or had their FDLE access suspended/revoked due to an investigation, or something else that's bad?

Regardless, it needs to go to a different dealer ASAP. And if they won't do that, it's an even bigger red flag, and time to start demanding answers as to what's really going on.

It’s a real business. They have a store front and an indoor range. I have transferred many guns in the past. It’s a hinky business in that I always wonder if they are close to going under. I have touched and shot the gun. They are open Wednesday through Sunday so I can’t do anything more until later this week.

For those who know, what exactly am I asking for? For them to ship the gun to another shop in town? This one is a new one for me.

How would I know that? They are on grabaguns ffl list, they have transferred as recently as last month for me and then this. I’m just trying to figure out what my options are. Having them ship it to another local dealer seems reasonable if more expensive. I am willing to do that. Can I force them to do that? Like I said this is uncharted waters for me.

It is your property and they are your agent. (unless you purchased the gun from them, but I don't think that is the case by what you have stated)

So, you have every right to demand they present it to another FFL for transfer without delay.

Does not mean they will comply, but that is what I likely would do of I believed they were not being razor strait with me.

No matter what or why they are "locked out", that is their problem and should be making it your problem.

The have no "right" to your property or to withhold it when they have a clear option to get it to you without further delay.

It's a possibility, and would explain the delay... They mistakenly let their FFL lapse, and now can't do any buying/selling/transferring until the renewal application is approved and issued, so they're stalling by blaming FDLE and just hoping it shows up soon.

pedropcola could check them through the ATF's EZ Check system, to see if it's valid and when the expiration is/was.

Wouldn't even necessarily have to ship it. They could simply take it over to a different dealer themselves.

Or, if both they and the other local dealer are willing, you could take it to the other dealer yourself. They log it out to the other dealer in their book, and then you (rather than UPS/FedEx) bring it to the other dealer to be logged in and then complete the transfer paperwork.

But if the first shop's FFL did expire, it would make even that difficult, since they can't do any transfer activity at all without an active FFL.

Yikes. It sounds like if their FFL expired this gets tricky. Which begs the question, if they don’t have a license can they even legally store my gun? Lots of questions. I go to work tomorrow and get back on Thursday. I will head over there and get a straight answer hopefully. I like those guys but I really want my gun.

I’ve never seen a selling FFL of any size (grabagun falls into this) ship a gun out to an entity that didn’t have an active FFL. I guess it could have expired or been yanked right after they got it. I have no idea if there is some kind of renewal grace period like “my paperwork is in I just haven’t gotten it back” sort of thing.

I’d be interested to hear the rest of the story when you know it, assuming you want to share with the class.

Good luck and gen though I am definitely a pot calling a kettle black, try not to get too pissed I’m sure it will work out and it’s just a “luxury item”………said the happy guy who if the situation were reversed would be LIVID!! Smile

Care to share who the dealer is, being in FL just curious.

you could contact ATF and ask them what the process is to move your gun from a business with an expired FFL to an active one.

Yeah been in that place, it's been around for quite some time, surprised they let the FFL lapse.


FGE is just down the road where we usually go to look and fondle guns, if it's going to be a while, maybe ask him to transfer it there so you can get it.
