Code requires a one hour fire rated wall in both the connecting wall and the ceiling. This is a national code.

I’m curious how the house passed inspection as this has been in the codes for decades.

One hour fire rating can be achieved with 5/8” drywall or Type X 1/2” drywall. I would strongly urge you to consider doing this and then running OSB (which is actually 7/16”). The second most common place for house fires is in the garage (the kitchen being first).

EDIT: Just saw where the party wall is dry walled.
