I'm sure his recent contract with Spotify for $100 million played a huge part along with all the other nonsense. That state is in a death spiral. The amount of families leaving California and moving to Park City, not Utah but Park City specifically, is crazy. Not to mention concerning.

California 13.3% Tax Rate May Be Raised To 16.8%...Retroactively

Most Californian’s think they already pay high taxes, and they are not wrong. But a tax bill, AB 1253 (Santiago), would impose even higher taxes, and retroactively to January 1, 2020. If passed, high income Californians would pay another 1% on income over $1,181,484, 3% on income over $2,362,968, and 3.5% on income over $5,907,420. These dollar thresholds look odd, but are $1M, $2M and $5M plus inflation adjustments. They would hit only very high income Californians, hiking California’s tax rate on income over $1 million from 13.3% to 14.3%. California’s highest rate would be a whopping 16.8%. You can read Assembly Bill 1253 for yourself. If it passes, it could cause some Californians to hop in their Teslas and head for Texas, Nevada, Washington, or somewhere else. Anywhere would mean lower state taxes. The current top 13.3% rate—which it is worth noting is the same on ordinary income and capital gain—dates from 2012.

With the 2018 federal tax law changes, paying 13.3% in non-deductible state taxes (after a $10,000 cap) is even more painful. Moving sounds easy, but if you aren’t careful how you do it, you could end up leaving California, yet being asked to keep paying California taxes. California has a broad reach into other states, and in some cases, California can assess taxes no matter where you live. Should this discourage you? No, but it pays to know what you are up against. If you live in California, you may know how aggressive California’s state tax agency can be. Even people living elsewhere have heard of the Golden State’s aggressive tax rules. California's Franchise Tax Board (FTB) monitors the line between residents and non-residents, and does so rigorously. Like other high tax states, California is likely to probe how and when you stopped being a resident.

For that reason, even if you think your facts are not controversial, be careful. A California resident is anyone in the state for other than a temporary or transitory purpose. It also includes anyone domiciled in California who is outside the state for a temporary or transitory purpose. Yes, that is confusing, and the burden is on you to show that you are not a Californian. If you are in California for more than 9 months, you are presumed to be a resident. Yet if your job requires you to be outside the state, it usually takes 18 months to be presumed no longer a resident. Your domicile is your true, fixed permanent home, the place where you intend to return even when you’re gone. Many innocent facts might not look to be innocent to California's tax agency.

For example, do you maintain a California base in a state of constant readiness for your return? Year after year, no state has a bigger cadre of would-be tax fugitives than California. Some Californians look to flee the state before selling real estate or a business. Some get the travel itch right before cashing in shares, a public offering, or settling litigation. Some of the carefully orchestrated deals and moves can work just fine. Yet, many would-be former Californians have unrealistic expectations about establishing residency in a new state. They may have a hard time distancing themselves from California, and they may not plan on California tax authorities pursuing them. Those rules are unforgiving, and when fighting California tax bills, procedure counts.

You can have only one domicile. It depends on your intent, but objective facts can bear on it. Start with where you own a home. Where your spouse and children reside counts too, as does the location where your children attend school. Your days inside and outside the state are important, as is the purpose of your travels. Where you have bank accounts and belong to social, religious, professional and other organizations is also relevant. Voter registration, vehicle registration and driver’s licenses count. Where you are employed is key. You may be a California resident even if you travel extensively and are rarely in the state. Where you own or operate businesses is relevant, as is the relative income and time you devote to them. Taxpayers with unrealistic expectations can end up with big bills for taxes, interest and penalties.

Your exposure to audit can also be frightening. The IRS can audit 3 or 6 years, but California can sometimes audit forever. Several things can give the FTB an unlimited amount of time to audit you. California, like the IRS, gets unlimited time if you never file an income tax return. You might claim that you are no longer a resident and have no California filing obligation. The FTB may disagree. That can make filing a non-resident tax return—just reporting your California-source income as a non-resident—a smart move under the right facts.

As people in the comments probably said he will probably pick Austin which isn’t really leaving California other than taxes.

Unfortunate he will be yet another Californian that hates what their voting did to their state so they move somewhere else and keep voting the same way.

With what he makes per year he would be dumb to stay. He also just signed a 100 million + deal to do his podcast so a retroactive tax hike would cost him millions.

I have very close family members who own rather expensive property in the Palm Springs and San Diego area and Winter there. They live in OK during the Spring, Summer, and early Fall. OK is their legal residence, no way do they want to get stuck paying CA income taxes. (All laws are followed). (San Diego is nice during the summer but Palm Springs gets up to 122 degrees or so during the summer).

They're not going back to CA this Fall to spend the Winter there. Too much is shut down, unavailable, or in other words just royally screwed up. They spent the last part of their Winter time under the draconian quarantine in CA of March, April, and part of May before escaping that crap and getting back to OK for the summer.

As far as Texas goes, well it's going to liberal hell in a hand basket. They're our neighbors to the south across the Red River, I have family and friends there, and most are in denial of how Texas is tilting and how that will affect not just them, but the rest of the country.

That does seem to always be the case. They also want to tell you how your state, city etc is doing things the wrong way and how it should be done like the place they just escaped from.

This is a topic that boils my blood. I live in Houston, not Austin.

There are many Californians moving to Houston and bringing their failing politics with them!

So Californians, if you move to Texas..get with the program. This State is great because our politics are 180 degrees from California. Let's leave it like that!

If you bring your failed California politics here, Texas will be just as bad as California!

All I can tell you about Joe Rogan is that the little bit I've listened to him, I just don't like him. I don't connect with what he says or his point of view. I just don't see the appeal. He can move to fucking Venus for all I care.

Decent weather? Austin? Are you kidding me? It’s always a few degrees hotter than DFW and more humid. It’s hot as hell there. A guy that is like my little brother lives in Austin so I get the updates every week. It’s little California there now. See the video above of the homeless. Californian bs coming to our great state. My friend is so tired of it. The Californian woman across the street called APD because his son was shooting his BB gun at a tree in the back yard. APD rolls, investigates, apologizes to my friend, then tells that lady tough shit. She says “well I’m from California and I’m scared of guns” he told her maybe she should move back there. He says they sell their expensive shit in CA, then move here, don’t even negotiate on price, and is driving pricing through the fucking roof. His neighborhood in Allendale used to be blue collar. His taxes are $1,000 a month now. I don’t know how much longer he can hang on before he has to sell it.

They have already invaded Dallas too. I see the plates, the bumper stickers and flags on their property. Sorry this is Texas, if you like Santa Barbara so much, or Seattle, or Denver, go the fuck back there, don’t bring that shit here.

I’m a native and I’m getting out of this fucking state as soon as it is possible. I’ve had enough. Dallas area has seen a 20% population increase. They say over the last 10 years, it’s more like the last 5, and they project another 20% over the next 5 years. Too many people and too many from California. I hate their liberal bullshit and want out. The traffic is insane now and the property taxes are out of control. I have to go to the County this week for my protest hearing.

Joe is definitely moving somewhere outside of Austin. That’s #1 place for Californians. They are all up in Colorado now, Utah, they are spreading their bullshit sickness in too many places. I’ve got people in Nashville and they say they are flocking there now too. Fuck. Go back to California, we don’t want you here. Get the fuck out!

Hmmm, sorry, but i gotta disagree with you there. I get completely not liking his style or point of view, but to say he is on the same level as Kim Kardashian is absurd. The man is involved in a whole lot more stuff than just his podcast which is literally just a small side gig for him. Rogan is super successful and wealthy because he busts his ass to be. The dude never stops working.
