Good for him, interesting in the news report that it states "Cass County Prosecutor Viktor Fit says he's waiting on the police to finish the investigation before deciding whether to file criminal charges against the customer" around 1:30 in the video...

MI law allow for the a defense of others so hopefully the customer won't be subject to some malicious prosecution and high legal bills...

Also the perp, well, you guessed it, he is a three time convicted felon... Go figure....

There is a legal doctrine of escalating force, well-matched according to the conflict. Slaps, fists, clubs, knives, guns...etc.

There is also the obvious need to stop imminent loss of life or serious bodily injury. Boxcutters can cause this.

Judgment time is milliseconds.

Outcome can be permanent.

It's not easy.

I wanna know what gun and ammo and where old boy to the hits.
Maybe the guy got hit in no fatal areas, or the good guy was using a mouse gun caliber

Mike, I don’t think this was your intent, but I see nothing “hood” about a gentleman who legally pursued the right venue for carrying a firearm, and used it in defense of someone else, in a moment where he could easily have walked away.

I believe there’s a different “H” word that could be utilized, especially as the customer stated he didn’t know what was in the perp’s hand.

Maybe it's there but I never got a good look the hood guys gun to make an ID on it, there is a brief view after he pulls it and reaches up to his head, he had trouble pulling it out on the way in and then his back to the camera.

I'm guessing the guy who defended was using a S&W Bodyguard, it's in a pocket holster, you can see him back up, pull it out of the holster, it also has either a light or laser.

Looks like his first two shots may have missed you can see something jump on the counter, and in the 1:08 time a bottle behind the Hood explode from impact of the bullet, so unless he's shooting something that will go through a body, he likely missed, and then the follow up shots from the bottom of the screen got the hits, that may be what the prosecutor is looking at, but the guys a civilian, not a cop, not his job to arrest Hood Guy, just to stop him..

Still, Kudos for him for stepping up, shouldn't matter what gun or maybe even a knife the Hood Guy had, he was behind the counter, threatened the clerk and was stealing.

"CASSOPOLIS, Mich. (WOOD) — A man accused of trying to rob a Cassopolis gas station while armed with a box cutter in July faces several charges, while the beer-toting customer who fired seven shots at the would-be robber will not be charged, according to the prosecutor.

The Cass County prosecutor’s office announced Tuesday that Cordelius Anthony Martin, 35, was arraigned Aug. 17 on charges of armed robbery, assault with intent to rob while armed and felonious assault. Martin was charged as a fourth-time habitual offender, and his bond was set at $100,000, the prosecutor said.

Meanwhile, the prosecutor said the customer inside the Stone Lake Marathon Mini Mart who shot at the would-be robber will not face any charges.

The customer had a valid concealed pistol license, as well as previous experience as a security guard, according to the prosecutor’s office.

The office said it determined the customer’s actions were “lawful and justified” to defend himself and the clerk: Michigan law states that if one is not engaged in a crime, one may use deadly force against another if one “honestly and reasonably” believes that using deadly force is essential to prevent imminent death or great bodily harm to oneself or another."
