In an extraordinary turnabout, a George Soros-backed prosecutor in St. Louis was ordered Tuesday to face a professional disciplinary hearing over her conduct in pursuing now-withdrawn criminal charges against former Republican Missouri Gov. Eric Greitens.

The Missouri Office of the Chief Disciplinary Counsel found probable cause that St. Louis Circuit Attorney Kim Gardner committed professional misconduct and should face a disciplinary hearing, according to records posted Tuesday evening by the Missouri Office of the Advisory Committee and Legal Ethics Counsel.

The proceeding now goes to a disciplinary hearing panel for decision on a possible penalty, which would then be imposed by the Missouri Supreme Court. Gardner will be able to defend herself at the hearing.

"All disciplinary hearing panel cases are filed with the Supreme Court of Missouri unless they are dismissed at the disciplinary hearing panel level or if the disciplinary hearing panel administers a written admonition that is accepted by the Chief Disciplinary Counsel and the Respondent," according to the state's rules.

Discipline can range from admonishment to the revocation of Gardner's law license. The order was based on a complaint filed by Greitens' attorneys more than a year ago. Greitens recently announced he is planning a political comeback, running for the open Senate seat in Missouri.

The supporting findings and complaint of the disciplinary counsel against Gardner were not immediately made public, and Just the News filed a requested Tuesday evening with the disciplinary office to release those records.

The order Tuesday, however, is the latest fallout from the decision by Gardner, a Democrat, to file criminal charges against Greitens, a Republican, in 2018 alleging that he used a cell phone picture of a girlfriend to make extortion threats.

Gardner was forced to withdraw the charges after admitting she did not have the evidence to substantiate them, leading to a dismissal of the case. But by that time, Greitens was forced to step down as governor in a bungled prosecution chronicled by a Just the News investigation last year.

Gardner was among the first local prosecutors to be funded heavily by liberal mega-donor George Soros' Missouri Justice & Public Safety PAC, becoming St. Louis' first black chief prosecutor in 2016. Soon, she would be mired in controversy over her confrontations with police over reform, her failed prosecution of Greitens and her recent efforts to charge a St. Louis couple with gun brandishing during last summer's protests.

She easily won re-election last year, but her legal troubles have far from disappeared. Her former chief investigator in the Greitens case, a former FBI agent named William Tisaby, has been indicted on seven felonies for misconduct in the prosecution and is awaiting trial. And Gardner herself is being investigated by a special prosecutor for her handling of the Greitens case.

Hopefully it will be a revocation and perhaps some jail time

Missouri's chief legal disciplinary officer accused St. Louis' top prosecutor of sweeping misconduct in the failed prosecution of former Gov. Eric Greitens, saying she lied to judges in court filings and testimony, withheld exculpatory evidence from the defense, misled her own prosecution team and violated the constitutional right to a fair trial.

St. Louis Circuit Attorney Kimberly Gardner, one of the early local prosecutors bankrolled by liberal megadonor George Soros since 2016, engaged in 62 acts of misconduct that resulted in 79 false representations during Greitens' now-dismissed criminal prosecution, according to Chief Disciplinary Counsel Alan Pratzel's memo obtained Wednesday by Just the News.

"Probable cause exists to believe that the respondent is guilty of professional misconduct," Pratzel declared in a 73-page memo that repeatedly accused Gardner of withholding evidence of innocence and providing a false portrait to the courts, the defense and even her own prosecution team.

Pratzel also accused Gardner of lying during the disciplinary proceedings, long after the case was dismissed against Greitens, a former Navy SEAL and rising Republican star who was forced to resign as governor in 2018 less than two years after he was sworn in.

The disciplinary action against Gardner follows the 2019 indictment of her former chief investigator in the case, ex-FBI agent William Tisaby, on seven felonies alleging he committed perjury and evidence tampering during the Greitens probe.

Gardner also remains under criminal investigation by a special prosecutor as Tisaby awaits a trial that has been delayed by the COVID-19 pandemic.

The unraveling of the criminal case was highlighted in a Just the News investigative report last year, prompting some to compare Gardner's actions to the FBI's now-confirmed misconduct during the pursuit of then-President Donald Trump during the Russia collusion probe.

Pratzel concluded that Gardner had violated her responsibilities as a lawyer and a prosecutor, essentially suborning Tisaby's perjury by "failing to take reasonable remedial measures when she knew Tisaby was giving false answers to questions."

"She offered and elicited false testimony when questioning Tisaby" during a deposition ordered by the court and also provided inaccurate information to a fellow prosecutor during a private session in the judge's chambers that later led that prosecutor to make false statements to court, the memo alleged.

Gardner, St. Louis' first black chief prosecutor, filed an initial response to the allegations, suggesting race and politics were involved in the disciplinary action but acknowledging she made mistakes in the Greitens prosecution.

"In hindsight, were each and every one of Ms. Gardner's actions in the intense, fast-paced Greitens investigation and prosecution perfect? No, but that is not the measure or purpose of the attorney discipline," her legal team wrote.

She claimed that she has been the "target" of attacks for her "tireless and courageous efforts to reform the criminal justice system" and was being treated differently compared to other lawyers.

"Attacks on Ms. Gardner have taken many forms, ranging from overtly racists emails sent to her office to investigations and lawsuits against her," her reply alleged. She also showed her continued disdain for Greitens, calling him a Republican "golden boy."

Gardner has been the object of frequent controversy and criticism, including as the focus of an ongoing special prosecutor's criminal investigation in the Greitens case, and was recently removed by a court in the prosecution of a St. Louis couple accused of brandishing weapons during last year's Black Lives Matter protests.

She has frequently used race as a defense, even filing a lawsuit under the Ku Klux Klan Act of 1871 last year alleging the St. Louis police union had mobilized to thwart her efforts to reform criminal justice and denouncing the "white, ethically conflicted special prosecutor" investigating her and Tisaby. That lawsuit was thrown out last September.

Pratzel's memo, however, provides the most direct and serious threat to her hold on the St. Louis prosecutor's office. Disciplinary action, if upheld by a hearing panel and the Missouri Supreme Court, could range from public admonishment to loss of her law license, the latter of which could end her tenure as circuit attorney.

The disciplinary memo cited a litany of violations of rules designed to ensure ethical behavior by lawyers and prosecutors, and fair trials for defendants. It alleged she made false statements in court filings, engaged in "conduct prejudicial to the administration of justice" and harmed Greitens' right to a fair trial by keeping required evidence of innocence from the defense.

Gardner violated "the rules of criminal procedure and court orders by concealing discoverable and exculpatory evidence," the memo stated.

Doubtful, she is stupid and incompetent all on her own. In the Greitens' case, most of the "evidence" came from elements of the Missouri Republican party, secret payoffs and things delivered through one of the bigwig's law firm.

I hope they are able to give her the most punishment she is eligible for, but I doubt it will happen.

Only Republicans are punished.

Greiten's was railroaded , kind of like Trump.

Having worked in LE for many years and having worked closely with many great prosecutors, nothing gets my ire up more than prosecutorial misconduct. I have seen far too much of this in recent years. They are the gatekeepers to the criminal justice system and this kind of behavior undermines public confidence in our system of jurisprudence. Professional ethics apparently mean nothing to people who cannot grasp the concept of ethics. But then again, a community gets precisely the quality of law enforcement that they deserve

Gardner admits wrongdoing in ethics investigation


Apparently, there are four levels of possible disciplinary action which could be taken against Gardner. From less to most severe, these are admonishment, reprimand, suspension and revocation of law license.

Reprimand has been recommended and now the 3-member ethics panel has 30 days to accept or reject the recommendation. Ultimately, the Missouri Supreme Court then will decide if and what punishment Gardner will receive.
