Hunter Biden offers to change plea to avoid a trial in tax case

Hunter Biden is attempting to resolve his federal tax evasion case in California with a plea where he maintains his innocence but will accept punishment, his lawyers announced in court Thursday, moments before jury selection was scheduled to begin.

The arrangement won’t be final until District Judge Mark Scarsi, a Trump appointee who has presided over the tax case, gives his stamp of approval in open court.

This type of arrangement, called an “Alford plea,” would see Biden acknowledge that special counsel David Weiss has enough evidence to convict him – and then he would accept whatever sentence Scarsi eventually hands down.

The potential resolution of the tax case comes on the brink of a trial in downtown Los Angeles. This would have been Biden’s second criminal trial this year, after he was convicted in June on three federal gun charges in Wilmington, Delaware.

Biden was charged with nine tax crimes, including three felony charges. Prosecutors allege that Biden failed to pay $1.4 million in federal taxes and evaded taxes by filing tax returns with fraudulent business deductions. They also allege that Biden was using his money on luxury cars, extravagant hotels and sex workers, instead of paying taxes when they were due.

The president’s son eventually paid roughly $2 million in back taxes and penalties after learning of the investigation and getting sober, following a years-long struggle with drug addiction and alcoholism. In the weeks before the trial, the judge blocked Biden’s lawyers from telling jurors about the belated tax payment, or about the potential origins of his addiction – dealing a major blow to his defense strategy.

President Joe Biden has continually said that he will not pardon his son in either of his cases. It is not clear if the president’s thinking has changed since dropping his reelection bid, but he still has the ability to pardon his son or commute his sentence.

In July, Biden added Los Angeles attorney Mark Geragos to his legal team. Abbe Lowell, who handled Biden’s gun case in Delaware, was expected to take a back seat for his tax case with Geragos as the lead attorney. CNN previously reported that there were plea discussions earlier this summer that did not lead to a deal at that time.

In Los Angeles, the criminals run the city… Whatever happens, this dirtbag will never receive the justice you or I would have received… Just another fake court case. All these charges are Federal and in a Blue State and easily pardoned by the President.

Yes, we all may get to see additional evidence as this goes forward. That's why he's so willing to plea out now, not later.
I doubt that Hunter will ever face justice and go to jail anyway.
Joe will pardon him on his way out the door, 100%.
There's no (political) downside if he does it.

I think if he did pardon him, the repercussions would be minimal. Joe is not really relevant anymore.

A trial would be very embarrassing, not just for Hunter, but also for the Big Guy, Daddy.
A trial would also help Trump.

Yep. Felony federal charges I presume. Should be. I have worked in healthcare in the past in the federal prison system. Medium security. Bank robbers and such. My bet he will get a pardon after the polls close and Biden is behind. In other words Joe will pardon. Less bad press.

Hunter pled guilty to avoid witnesses outlining the Biden influence peddling organization. Keep in mind that the SCOTUS ruled in the Trump case that a president is protected for his official acts only and can be criminally charged for others.

Hunter's team didn't want that hanging over Joe with exhibits and sworn testimony.

Even if Joe pardons him, that means Hunter can be deposed, and he can't refuse on the 5th.

Update (1505ET): It would appear that Hunter Biden doesn't have a nicely arranged plea deal with the DOJ after all - as prosecutors have urged the judge in the case to reject his proposal to plead guilty.

Of note, Hunter is attempting to plead guilty via an "Alford plea," which would have to be approved by the prosecution and higher-ups at the DOJ.

It appears they were caught off guard.

Department of Justice prosecutors rejected Hunter Biden‘s offer on Thursday to enter an unusual plea in his criminal case in California that would involve the first son accepting guilt for the nine tax charges he is facing while avoiding admitting to the underlying allegations in his indictment.

Leo Wise, a prosecutor working on behalf of special counsel David Weiss, told Judge Mark Scarsi that Biden appeared to be asking for “special terms.”

“Hunter Biden is not innocent. Hunter Biden is guilty, and he’s not allowed to plead guilty on special terms that only apply to him,” Wise said, according to a report from the courtroom.

The decision by the special counsel’s team to urge Scarsi to move the case to trial comes after Biden’s legal team surprised prosecutors Thursday morning by entering what is known as an “Alford plea” just before jury selection in the case was set to begin.

“This is the first we’ve heard of this,” Wise told the judge earlier in the day, according to NBC.

Scarsi proposed punting jury selection until Friday to allow the government to prepare a full argument against Biden’s Alford plea.

An Alford plea involves a defendant admitting that there is enough evidence in a case for prosecutors to secure a guilty conviction, but it allows the defendant to avoid admitting to any allegations.

In Biden’s case, it would allow the first son to avoid admitting in court that he made millions of dollars from foreign business dealings and spent the income on frivolous purchases, all while neglecting his taxes.

It would also allow Biden to avoid a weekslong trial that, according to court filings, is expected to delve deep into the first son’s past personal struggles with drugs, alcohol, and women during the 2016 to 2019 time period, when he allegedly did not pay his taxes.

The hearing was still underway as of Thursday afternoon, and it was unclear how Biden and his defense attorneys would respond to Weiss’s unwillingness to accept the first son’s plea terms. Legal experts with experience working in the DOJ, including conservative defense attorney William Shipley, took to X to explain that the department never agrees to Alford pleas.

Oh, he wants a sweetheart deal.

He'll admit there's enough to find him guilty but he wants to say he doesn't agree there's a factual basis. Interesting development.

When people plead out, the judge goes through a long list of things he asks the defendant, such as waiving a right to a trial, the right to cross X witnesses, including asking if he agrees there's a factual basis for guilty plea. Hunter wants to avoid that embarrassing shit show.

Weiss should reject it outright and plan on going forward.
