FBI Deputy Director Andrew McCabe to retire: Report

FBI Deputy Director Andrew McCabe is planning to retire in early 2018 when he becomes fully eligible for pension benefits, according to a new report.

McCabe, 49, has faced renewed criticism from Republican critics in recent weeks following accusations of bias in the FBI and the belief the bureau let Secretary of State Hillary Clinton off easily during its investigation into her private email server.

"It would send a terrible message to move him now, but it's also a terrible situation he's in," one law enforcement official told the Washington Post, which first broke the news Saturday.

A spokesman for McCabe, as well as the FBI, declined to comment for the story.

McCabe faced hours of questioning behind closed doors on Capitol Hill this past week as top Republicans are investigating alleged bias in the FBI, expressing deep concern over the release of anti-Trump, pro-Clinton messages exchanged between two top FBI employees. According to reports, Republicans were not pleased with his responses to their questions about alleged bias.

One of those employees, Peter Strzok, worked on the investigation into Clinton before being assigned to special counsel Robert Mueller's team; but has since been removed and demoted.

In one of the texts from Lisa Page to Strzok, she wrote: “I want to believe the path you threw out for consideration in Andy’s office that there’s no way he gets elected — but I’m afraid we can’t take that risk. It’s like an insurance policy in the unlikely event you die before you’re 40.’’

McCabe also served as former FBI Director James Comey's right-hand-man, assuming the position of deputy director in February 2016. Congressional committees are currently investigating Comey's handling of the Clinton probe.

The Justice Department's inspector general is also investigating McCabe for not recusing himself from the Clinton investigation. During the time of the investigation in 2015, Democrats donated money to his wife's Virginia state Senate campaign.

Fire him first. No need to wait until next year.

The FBI’s top lawyer, James Baker, is being reassigned — one of the first moves by new director Christopher A. Wray to assemble his own team of senior advisers as he tries to fend off accusations of politicization within the bureau.

Baker told colleagues he will be taking on other duties at the FBI, according to people familiar with the matter. In recent months, Baker had been caught up in a strange interagency dispute that led to a leak probe and attracted the attention of senior lawmakers, but people familiar with the matter said the probe had recently ended with a decision not to charge anyone. The leak issue had not played a part in Baker’s reassignment, these people said.

Baker informed colleagues in an email Wednesday that his duties were changing at the FBI, according to people familiar with the matter. Two said he is being “reassigned’’ by Wray, but they cautioned that the change does not take effect immediately and such a move is a normal part of a new director taking charge at the bureau — not a reflection of the political controversies buffeting the FBI.

House Republicans are investigating contact between the FBI's top lawyer and a Mother Jones reporter in the weeks before the left-leaning outlet broke the first news story about the existence of a disputed dossier alleging ties between President Donald Trump and the Kremlin, according to two congressional GOP sources who described documents linking the two men.

The GOP sources said the documents — made available recently to lawmakers by the Department of Justice — revealed that James Baker, the FBI's general counsel, communicated with Mother Jones reporter David Corn in the weeks leading up to the November 2016 election. Corn was the first to report the existence of the dossier on Oct. 31 and that it was compiled by a former high-level western spy.

Corn denied that Baker was a source for his story on the dossier.

"I'm not going to discuss my sources. But in order to prevent the dissemination of inaccurate information, I will say that James Baker was not my source for this story," he said in a statement to POLITICO.

The congressional sources said there's no conclusive evidence that Baker aided Corn's reporting or acted as a source. But Republicans are pointing to the connection to cast suspicion about whether FBI officials had a hand in directing the details of the dossier to reporters, and the two sources said they expect it to be a focus of GOP investigators' upcoming lines of inquiry.

Baker's connection to Corn comes as Republicans in Congress have been raising questions about the FBI's handling of the now-famous Steele dossier, named for Christoper Steele, the British former intelligence agent subsequently identified as the author of the document.

Baker was on Capitol Hill on Tuesday as counsel for Andrew McCabe, deputy director of the FBI, who testified to the House Intelligence Committee in the panel's ongoing Russia probe.

During the closed-door session, Republicans grilled McCabe about who at the department was authorized to talk to the media. One Republican at Tuesday's intelligence committee interview with McCabe laid out a " hypothetical " example of the FBI's general counsel meeting with a Mother Jones reporter.

McCabe, according to a source familiar with the exchange, said such a meeting would be unauthorized, according to the source.

Sources familiar with the congressional investigations said Baker did not return Thursday when McCabe came back to testify before the Judiciary and Oversight Committees in their related inquiries.

Fire him the day before he'd be eligible for his pension.
