Friend of mine bought a Kel-Tec SUB2000 Gen. 2. It's in NICS check purgatory. Thing is: He has a Michigan CPL. I thought having a CPL obviated the need for NICS checks, but he says the store says "Not for long guns. Only for handguns." Is this true?

That kinda sorta doesn't make sense to me.

If you have a Michigan CPL, no NICS check is required for purchase of a firearm; long gun or handgun. Been selling guns in Michigan for 22 years, so hopefully I’ve been doing right...

NICS checks not required with a valid CPL.

If he's in the oddball period of expired-but-renewed and just waiting for his new license he can carry but the NICS checks must be done and permits to purchase pistols are in effect.

Are you certain of that? Last time I renewed (almost time again): If your CPL expired you could not carry.

If you renew and your license expires before your new one arrives the expired license and receipt from renewal acts as your permit. This is not true if you renew after expiration in the 1-year renewal period.

And the next item in the list from that website:

I'm not an expert, but that's the only time I'm aware of a NICS check being needed when one has a "valid" CPL.

I have a Michigan CPL. I have purchased both long guns and hand guns and a few AR recievers at a few different places with no check. I bought a shotgun at a store, they asked and I gave my them my CPL and they still did a check... Could be a store policy to run the check. Just a guess.

Michigan CPL exempts holder from a NICS check. I am "on call" at a small shop.

4473 Form has a check box and a section to record the information from the CPL.

I know that some retailers refuse to waive the NICS check for CPL holders, Cabela's is one.

Michigan's CPL statute provides an Exemption for the NICS check for those with a Concealed PISTOL License. Note the work PISTOL. Some stores have lawyers that have advised them that this is a "grey" area in the Law and some Courts might interpret this as meaning that the Exemption ONLY applies to Pistol Purchases. The end result of this is some dealers will not recognize that Exemption as being applicable for Long Gun purchases. Note, this particular quirk most frequently comes up at small dealers who don't sell very many firearms. Go to any of the major dealers and they all will use that Exemption as it was intended and bypass the NICS check for those with CPL permits for any firearm purchase that isn't a Full Auto.


I've stopped counting.

Excerpt from Giffords Law Center (yep, that Giffords) :, Michigan handgun purchase license holders, and Michigan concealed pistol license holders with licenses issued on or after November 22, 2005, are exempt from the federal background check requirement when purchasing a firearm.
