Wife and I was rear ended late last year by a teen on a cell phone. No fault of our own. Caused an ambulance ride for the wife, $25,000 in medical bills, and a couple thousand dollars in damage to my 2017 car. KBB shows dealer value on my car to be $21k - $25K. I asked for diminished value. Today they sent me a check for $80 to cover the diminished value LMFAO Does anyone know how the diminished value claim works in Florida? I felt like the $80 was a slap in the face and now that my car has an accident on its record, it is worth far less than that $80 check... ______________________________________________________ Often times a very small man can cast a very large shadow | ||

IANAL but I have seen insurance companies do that more than once. Send you a small check and if you cash it you settled for it. I had them send me a check for $1200 check for a 17K loss. I wrote void on the check, sent it back, and ask when they wanted to go to court. After a couple of months of back and forth, I received my check for fair market value for the car. | |||

I hate to say it, but you're lucky you got 80 bucks on a couple grand worth of property damage for DV. I used to handle DV claims as part of my regular claims handling duties. Unless there is frame damage, DV isn't the cash windfall everyone seems to think it is. And even then it's not much. You can trying arguing to try and get more money out of them, but at best all you're likely to get is a couple hundred bucks. And don't go for one of those diminished value appraisal companies. Those usually cost a couple hundred bucks and their estimates are inflated and most insurance companies throw them away. | |||

I’ve handled a couple of these in Florida. I used the KBB value before the accident and after - in both instances there was frame damage which dropped the value significantly. | |||
