I especially like the fact the robber's partner is charged with 2nd degree murder (per felony murder rule) for the death of his partner in an apparently legitimate self-defense shooting by the victim. Cool

I'm not familiar with Florida laws. However, in Texas Penal Code Title 2, Chapter 9, Subchapter C, Section 9.31 gives the following restriction on using deadly force in protection of persons:
quote:
(3) was not otherwise engaged in criminal activity, other than a Class C misdemeanor that is a violation of a law or ordinance regulating traffic at the time the force was used.
BTW, in Texas 1/8 ounce would be a Class B misdemeanor.

Does Florida have similar restrictions on claiming self-defense?

They are all criminals and should pay the price for the drug deal.
IMO, none are murderers.
Never like the murder-felony rule, even though it is legal and has been upheld.
It never set well with me as being just.

I think it is an extension of our castle doctrine which applies to your vehicle once a person enters it and threatens you, you get the assumption of being in fear for your life, therefore deadly force is ok to dispense at the perp.

I don't think it has anything to do with the amount of drugs. It is the threat of the shooting and the plan to commit armed robbery and the act of doing it that landed the 2nd degree charge

FTW! I don’t know how you can post a Sheriff Judd story without a quote from the man. Roll Eyes Wink

Also according to this article, Link, the guy doing the shooting got into the front passenger’s seat of the drug dealer/Uber driver’s vehicle. The guy that got shot got into the back seat a little later and started beat the shooter over the head with the fake gun.

That’s straight up self-defense.

The drug dealer and the dead guy were friends and had planned the robbery. I’m ok with the felony murder rule in this case as well.

I understand the guy doing the shooting is also a bad guy... probably a gang banger and that he has multiple previous... but in the current instance that doesn't matter. Self defense.


I'm a fan of Grady.
On another instance where they caught some teens burglarizing cars...

Grady... Why are we disclosing the identity of the perps despite them being minors... because the Supreme Court said we can.

Since in FL you can be charged with anything that happens during the commission of a crime you are involved in committing i.e. your partner kills the guy you are both robbing you can be changed with murder as well, and both parties were committing crimes that resulted in one guy being killed, I wouldn’t be surprised if the shooter ends up getting charged as well.
