last I read, they were a co-equal branch of the government
not subordinate
do they not give a rats ass about the government and its actions?
does not their turning a blind eye to all this make them equally complicit in the downfall of the country?
what the hell do they do all day? last I checked, aren't we paying them full time?

It needs a case to be brought to them, secondly they do not rule arbitrarily or make law themselves.

Skull LeaderThe executive orders undermine the power of Congress. They are the ones that need to step up and push back on these orders. I don't think its the tradition of the SC to interject itself into disputes unless a lawsuit has been filed.
That's just my take on the matter. I'm not a lawyer or anything.

has ruled on several issues. The commies don't care and are simply doing as they please, lawful or unlawful, because there is no one to hold them to account. Not the Justice Dept, not Congress, and not the voters.

corsairThe bigger question is why isn't Congress, as in BOTH houses, NOT putting their foot down and reasserting their balance of power....looking at the House since the SOTH is #2 is line of succession.

Congress is perfectly happy to have the executive branch enact controversial policies so they do not have to answer for voters for doing so (or not doing so). They operate under an informally-agreed stalemate that allows them to do nothing of substance and then blame the other party to drive donations and voter turnout.
The most basic function of Congress is to pass a budget and they haven't done that on time since 1996. I'd love to borrow Canada's approach - if their legislature doesn't timely pass a budget it acts as a no confidence vote and they all get fired.

egregoreEven if the court rules in our favor, there is no enforcement mechanism. Whether this is a fault or feature of the Constitution I don't know. Eisenhower sent troops to enforce desegregation of schools, but there was nothing saying he had to. Conversely, Andrew Jackson famously told the court to piss off and went ahead with the forced removal of the Indians from the South. You can bet the Biden administration won't obey any such rulings.

Legislative: this branch makes the laws
Judicial: this branch interprets the laws, and
