Baltimore prepares for protests (Freddie Gray case) Update: 4th Circuit Appeals blocks suit vs Mosby
Going back in time to May 2015

http://legalinsurrection.com/2...s-lead-investigator/

Meet Prosecutor Mosby’s Lead Investigator

it appears that Prosecutor Marilyn Mosby was running an independent investigation in parallel with that of the Baltimore Police Department.

Naturally, any investigation has a lead, and so it seems worthwhile to ask who Mosby assigned to that sensitive and responsibility-burdened position for her own investigative team.

Avon Mackel

Mr. Mackel used to be a high-ranking Baltimore police officer

until things went horribly wrong.

In 2009 Mackel was stripped of his command position because of a grievous failure to follow through on allegations of a mishandled robbery investigation by two of his officers.

In addition, according to that same CNN report the Baltimore Sun newspaper reported that police in Mackel’s district were falsely “down-classifying” crimes in order to suggest crime rates were lower than was actually the case–and to make Mackel look more effective as a crime-fighter than he was.

Four months after his demotion, Mackel engaged in a drunken gun-wielding incident at his home of sufficient severity that the Baltimore County police department sent in their SWAT team. Mackel was non-compliant with officers and obviously (the responding officers reported) intoxicated.

Despite being tasered by the SWAT team, the armed and intoxicated Mackel managed to barricade himself in his bedroom.

After that, the police record apparently gets vague, without any clear explanation for how the incident ended.

Mackel was not arrested following these remarkable events.

It sounds like Goodson may very well walk as well.

Don't we have a 2nd Degree Murder trial coming soon?

Holy shit.... The guy she had investigate the incident was a disgraced former cop?

And fuck that Sherriff. He deserves to burn at the stake next to Mosby.

Goodson is charged w second-degree depraved heart murder.

His charges are the most serious of all 6 officers.

So this is the biggest of the cases then.

The prosecution would be lucky if they could get negligent homicide, if even that.
Can the judge find the defendant guilty of a lesser charge that did not originate as an original charge, or does the judge just rule on the exact charge(s).

Officer Goodson acquitted of all charges in death of Freddie Gray

Good call by Judge Williams.

Judge Williams said the prosecution failed to show Ofc Goodson intended for anything bad to happen to Gray

Judge Williams said state only showed failure of duty re no seatbelt at stop 4; may be "mistake" or "bad judgement," but not crim negligence

I had serious doubts about Judge Williams, but he did the right thing.

Judge Williams called "rough ride" an "inflammatory term" that is "not to be taken lightly," and said prosecution didn't prove it at all.

Judge Williams said state offered theories not backed by evidence. "The court cannot simply let things speak for themselves"

Judge Williams said the competing medical expert testimony presented 5 plausible scenarios for when Gray's injury occurred

Judge Williams said #FreddieGray 's injury "manifested itself internally." "How would the average person without medical training know?"

Williams repeatedly cited state's own med experts re Gray retaining some function after injury, suggesting would be hard to tell hurt

Acquitted of all charges. Not surprising. The DA should do the smart thing and drop charges against the rest.

But we know that won't happen.

I'm a deplorable.

So do they light the CVSs on fire now and get their free flat screens, or do they wait until all 6 have been aquitted? What is normal protocol.

Good things coming out of Baltimore!

I hope this kills Mosby's career, and puts a crimp on BLM movements.

If Goodson did not kill him or cause the injuries that killed him, then which of the 6 could have?

The answer would appear to be none of them. So, all charges must be dropped, or am I oversimplifying this?

Wonderful. Well done on the judge's part. This was all a grave misjustice from the start, but at least in the end it was set straight.

Now it's time to prosecute Mosby and that absurd mayor and sue the bejesus out of that city.

In sports, you have to play the entire season, no matter how lousy you are.

In legal cases, you can exercise discretion in the interests of justice.

Luckily, I have enough willpower to control the driving ambition that rages within me.

When you had the votes, we did things your way. Now, we have the votes and you will be doing things our way. This lesson in political reality from Lyndon B. Johnson

"Some things are apparent. Where government moves in, community retreats, civil society disintegrates and our ability to control our own destiny atrophies. The result is: families under siege; war in the streets; unapologetic expropriation of property; the precipitous decline of the rule of law; the rapid rise of corruption; the loss of civility and the triumph of deceit. The result is a debased, debauched culture which finds moral depravity entertaining and virtue contemptible." - Justice Janice Rogers Brown

Not for a reasonable person. Mosby however has fully committed to putting and officer in jail. Unless stopped she'll keep trying. Her only "out" is to drop charges and claim that the system won support her. Likely claim that the bench trials did not reflex the will of the people.

Although it is 20/20 hindsight, excellent decision by defense to go w bench trial.

What are the odds that prior to this incident she has put other innocent people in jail?
