in the end karma always catches up |
I backed into the front of our Miata back in the fall. I parked it behind our Forrester while I was working in the garage. I was going to training with the dog a couple of hours later and totally forgot about it being there. It sets below the sight line of the rear view mirror and the back up camera hasn’t worked since we got the car… so. I was so pissed off, especially since we were planning on selling it in the spring. Has nothing to do with where the accident happens, on your property or not, but how the vehicles are owned. If you are not on his title than the insurance will cover his damages just as if it were your buddy's car parked there. It depends on the policy and the state. Its commonly called a "household exclusion" where the liability coverage on the policy of the vehicle in motion states that there is no coverage for property you (a defined term generally meaning you and your spouse) own while damaged by you while driving another vehicle you own. If that exclusion didn't exist in most states there would be a lot of people damaging their own property then claiming it on their insurance repeatedly because they can and they want the money. In Some states this typical exclusion doesn't apply if the vehicles are titled separately (like if your dad had his vehicle titled solely in his name and your vehicle was titled solely in your name) because it's not considered "your" property as defined by the policy. To all the "pay it out of pocket" people, that depends on the financial situation and the amount of damages. $500 to $1000, which is a typical deductible, pay it from cash, over that like $5K, let the insurance cover it.

Also worth noting to the "pay out of pocket" folks is that car repair costs have skyrocketed over the last decade, and especially the last few years... If you haven't needed collision repairs lately, you'd likely be shocked by how much it costs. I had a minor fender bender in 2019, where someone dented my rear quarter panel and broke one of the rear tail lights. It was like $5k to repair and repaint it, on a 2 year old car. My girlfriend had a similar minor fender bender with similar damage last year. It was almost $14k ![]() Therefore, judging by the OP's statement that the truck "received significant damage", it's going to be well more than just several hundred or a few grand to repair it. Because it was $14k to repair what I wouldn't consider anywhere near "significant damage" to my girlfriend's car. So with what sounds like a lot more than just a little bit of cosmetic damage, it's almost certainly going to cost more than most folks would have on hand to be able to just "pay out of pocket". And on a 20 year old truck with more than just minor damage, it's most likely totaled. Your best bet to avoid turning it in to insurance is to get a couple repair opinions, and if what I suspect turns out of be correct (e.g. that it's going to cost way more than the truck is worth to fix it, and way more than you have available on hand), then sell the truck to a salvage yard and use that money plus whatever out of pocket money you have to help him get a different used vehicle. Probably won't be another truck, because used truck prices are ridiculous right now, but you can find something reliable to get him around for $5k-$10k.

And the best way to do that is with a demand letter. Certified mail for best effect. ![]()

Or if it's not totaled and can be fixed/driven just list it on Facebook marketplace and sell it as is, vs a junkyard, or, if you are patient and like tinkering, part it out on Facebook, sell, tires, wheels, engine, trans, interior you'll get more than selling the whole thing.

My state farm agent and I go back 30 years. I just ask him. I have four vehicles with him and an Umbrella policy. Hopefully that is the case with you.

It's all part of the adventure... |
Back in 1984 my girlfriend had parked her brand new 1984 Mercury Cougar LS in our driveway behind my mother’s car, and we were going out to dinner with my parents. So my father got in his 1984 Lincoln with the A/C on full blast and the stereo on, and proceeded to back out of the garage. Somehow, as my girlfriend and I were standing there watching and yelling and so forth, he backed into the door of her Cougar. At that point he realized what he’d done and pulled forward clear of her car. When he did that, the door popped back out to normal with nary a scratch in the paint on her car, and of course, no damage to the bumper on his Lincoln. She never parked in the driveway after that as I recall. ![]() Regards From Sunny Tucson, SigFan NRA Life - IDPA - USCCA - GOA - JPFO - ACLDN - SAF - AZCDL - ASA "Faith isn't believing that God can; it's knowing that He will." Neighbor a few houses down the street hanged himself in his garage. I got home from work, did not know what had happened, but our street was full of police cars, fire department vehicles, etc. Because of all the responding vehicles, I had very limited room to maneuver into my driveway. No backup camera on my delivery truck, my picture via the side view mirrors assured me that I was going to be clear of my wife's new Ford Escape Hybrid. C R U N C H !!
