A progressive district attorney has declined to charge a Tim Walz state employee allegedly caught causing $20,000 damage by vandalizing half a dozen Teslas — a decision ripped by the “frustrated” local police chief.

The suspected vandal, 33-year-old Minnesota government employee Dylan Bryan Adams, was allegedly spotted keying the vehicles and stripping their paint off while out walking his dog around the city.

Despite what police believe to be evidence of Adams committing felonies, Hennepin County District Attorney Mary Moriarty will seek diversion rather than criminal charges.

“This is an approach taken in many property crime cases and helps to ensure the individual keeps their job and can pay restitution, as well as reducing the likelihood of repeat offenses,” the attorney’s office said in a statement, CBS News reported.

Minneapolis Police Chief Brian O’Hara said at the time of the incident that the damage in each case was the equivalent of a felony.

The chief said in a scathing statement on Monday that Moriarty’s decision not to bring charges is frustrating for his officers and the public.

“The Minneapolis Police Department did its job. It identified and investigated a crime trend, identified, and arrested a suspect, and presented a case file to the Hennepin County Attorney Office for consideration of charges,” he told KARE in a statement.

“This case impacted at least six different victims and totaled over $20,000 in damages. Any frustration related to the charging decision of the Hennepin County Attorney should be directed solely at her office.

“Our investigators are always frustrated when the cases they poured their hearts into are declined. In my experience, the victims in these cases often feel the same,” O’Hara said in a statement.

Moriarty has been Hennepin County’s top prosecutor since January 2023, but quickly came under fire for her woke policies that allowed accused rapists and killers to stay free.

During her very first week in office, she dropped the charges against a 35-year-old man accused of raping a teen girl due to attorney misconduct, CBS News reported at the time.

Per the linked article, the damage was reported to be more than $20,000. Does anybody really believe that the miscreant will actually pay restitution?

Perhaps there should be some sort of bond in place for this kind of stuff.

Serve time or put up a bond for the amount of damages. No restitution, go to jail. Do not pass go.

Asking, out of my own ignorance:

In this case, what recourse does the vehicle owner have? Any?

Is a damage claim with his insurance company all he can do? Or does he have any leeway to go after the criminal personally, despite the district attorney's not seeking criminal charges?

Does either the vehicle owner or the insurance company have a path to restitution from the criminal?

Each owner should be able to sue the perp in small claims court. As this was a criminal act, any insurance the perp has would most likely not pay. Therefore he can be forced to pay up, possibly at only $100/month, but he has to pay. If he misses a payment, the entire amount could be garnished from his wages.

If they are insured then the damage is not Collison (unless the guy rams one with a 4 wheeler).

In these cases it's comprehensive damage, so they will turn it into their insurance, if they have proper coverage, and the loss would be monetarily the deductible, $100, $500, $1000 so it would be small claims court for that amount. Probably not worth chasing.

Now the insurance companies could go after the guy for all the damages they pay for, and that would be the fiscal recourse, and you'd have every carrier filing their own lawsuit...

Of course the damages will be reported to all the vehicle online monitoring services, the CarFax will show damage repaired, so you could go after some loss of value claim, maybe emotional distress, say you became afraid to drive the car, leaving it outside caused you stress etc.

If he has resources to pay, a job, some way to recover damages.

Get a judgement, turn it over to collection, have multiple agencies calling him daily for the money, dunning notices, make his life miserable, until he has to file bankruptcy or pay the judgement to stop it...

Per the article, this is being handled via a diversion program.

Under those, at least in most places, in exchange for a guilty plea and a sentence, after a period of good behavior and making complete restitution for the harms done (restitution is paid while in the diversion program, not afterward) you avoid jail and a record. Don't make the restitution or not exhibit good behavior and you are adjudicated guilty and receive the sentence that was left dangling like a Damoclean sword.

In any case, as I did in a criminal case where I had a sum of money stolen, I'd sue the fucker in court just to have a civil claim against him as well. In my case, the guy didn't make the restitution ordered in his criminal case, and ended up looking at doing three years in Maryland on unrelated charges, then doing two more in Virginia and he'd still owe me a non-discharged debt that I was going to collect. That got him to pony up the restitution, PDQ.

Victor Divergilio Charged In Tesla Damage At Roosevelt Mall

An 83-year-old man left thousands of dollars in damages in his wake following a Tesla vandalism spree at a Long Island shopping mall, police said.



Victor Divergilio, of East Garden City, was arrested in connection with the alleged spree, which occurred in the parking lot of the Roosevelt Field Mall shortly before 2 p.m. Sunday, April 20.

An investigation found that Divergilio entered the parking lot, walked alongside five brand new Tesla vehicles, and used a sharp object to leave deep scratches on them, Nassau County Police said.

The spree caused approximately $23,000 worth of damage to the vehicles, police said.

Divergilio was arrested at his Wheeler Avenue residence on suspicion of criminal mischief. He was arraigned at First District Court in Hempstead.

The incident comes amid a nationwide uptick in politically motivated vandalism targeting Tesla vehicles following CEO Elon Musk’s appointment overseeing the Trump administration's Department of Government Efficiency (DOGE).

Divergilio allegedly used a key to carve up the five Teslas around 1:50 p.m. but denied doing it when police showed him footage that appeared to show him scratching the vehicles, the complaint said.

“Yeah, that’s me but I wasn’t keying any cars,” he said, according to the complaint.

“Yea but I was getting my keys because I had just paid and I wanted to see how much money I had.”

He then violently ranted about Musk and President Trump, the complaint said.

“Musk owns Tesla yea, he’s getting thrown out at the end of the month. He should die alright so should Trump f–king die,” he allegedly said.

Divergilio was charged with criminal mischief and released at his arraignment in Nassau County Criminal Court Wednesday morning.

At his arraignment, Divergilio was ordered by a judge to undergo a mental health evaluation.

On Wednesday, he told The Post he had gotten off a bus and was holding groceries and the keys because he sometimes loses them while walking home.

“I didn’t do what they said. I just spent a horrible night in jail like a criminal,” said Divergilio, who described himself as a Vietnam veteran who suffers from PTSD.

“I walked through and they say I scratched the cars.”

He is due back in court on April 30.
