Is it legal to exceed the speed limit by a certain MPH for a certain distance to pass?

I once got a speeding ticket while passing someone on a two-laner, so it's apparently illegal here. Either that or I ran into a highway patrolman having a bad day who decided to be a real dick.

No. there is nothing in the law that permits that legally. That's based on NJ that I was familiar with in my former employment.

But why have a law that duplicates laws already on the books. "Failure to Keep Right" is in almost every state.

That actually IS legal (to some extent) in MN on two lane roads.

Subd. 2a.Increased speed limit when passing. Notwithstanding subdivision 2, the speed limit is increased by ten miles per hour over the posted speed limit when the driver:
(1) is on a two-lane highway having one lane for each direction of travel;
(2) is on a highway with a posted speed limit that is equal to or higher than 55 miles per hour;
(3) is overtaking and passing another vehicle proceeding in the same direction of travel; and
(4) meets the requirements in section 169.18.

Indiana put a right lane except to pass law on the books last year. It hasn't changed anything, and to my knowledge it's not being enforced.

Yep. No enforcement that I've seen when over there.

Not in NC. The speed limit is THE LIMIT, one mile over it an you are breaking the law....But when I run radar I won't even turn around on you unless you are going 16 over (misdemeanor territory-between 1 and 15 over is just an infraction)

It is supposed to say "Keep right, except to pass". You are not supposed to be in the left lane at all unless you are actively passing another vehicle. That is the way the interstates were set up 60 years ago. It has always been a law, but apparently forgotten. There is no need to pass a new law. This is ridiculous. Even more ridiculous is that states like TN and GA announce they are going to enforce the law, but they don't.

That's the way it is in Missouri too, and most officers won't mess with you unless you're 10 over.

I have had this debate with members on the forum in the past when it comes to obstructing the left lane and speeding. Some have a difficult time understanding how doing something legal (driving the speed limit) can also be illegal (obstructing the left lane) at the same time.

I think the answer is to equip every driver with a dart gun and flagged suction darts. The flag says s**thead. When a car has enough darts on it, the driver gets pulled over and cited for being a scathead. Big Grin

Where? Not on any freeway, whether interstate, US or state, I've ever seen. They all say "slower traffic keep right." I have only seen "keep right except to pass" on the passing lane of two-lane highways. Maybe this is something done in the northeast or southeast US which I haven't been to yet. If I'm engaged in passing other cars that are in the right lane, which likely means I'm already +10 or more, and you still want to ride my ass, you can wait until I'm done. (In general, not you personally.)

From what I have seen on I-40 and I-81 in TN, to a lesser extent on I-26, there is no speed enforcement of any kind anyway. People haul ass.

It's been the law here in Washington forever but not really actively enforced. Last year the WSP announced that they will be enforcing the law now and writing tickets for the infraction. I haven't seen any proof of that yet and I haven't seen any noticeable change in driving habits. We'll see, but I'm not getting my hopes up.

I just spent 6 hours on the interstate in Florida. A full 75% of drivers park their ass in the fast lane doing the speed limit or 3 mph over, without a care in the world, as traffic backs up behind them and people get all pissed off.

It is becoming such a problem in this country.

So I move to the left lane to allow traffic to merge and get pinned in the left lane by the guy who moves right behind me doing 90 and the merging traffic on my right. I have nowhere to go and I am the "self absorbed prick". What would be the adjective for the law breaker behind me who thinks his time is more valuable than everyone else's? I really like the guys who, as everyone else is forming one lane for upcoming construction, pass us all to get to the front of the line then butt in. I am told my Corvette will do 174, probably one of the faster rides out there. After 57 years of driving, I have yet to get speeding ticket number one because I try to obey the law.

My dad is the WORST at doing this, drives me crazy riding with him. He will drive in the left lane going 4 MPH over, I say "dad get over, people are wanting to drive faster" and he says "I will after I get around the next car." then he will say "I'm going faster than the speed limit"

His reasoning is going 4 over is not as bad as going 15 over well, its no different both are breaking the law.
