tleddyI am old (79)... I have spent my adult life through five years Army, four years of college, my working life and now, retirement as a strong Centrist.
Now, I feel under attack by the Left, categorized as a racist, elitist, war-monger etc. etc. As a result, I find myself becoming that of which I am accused!
As a result, for the first time, I have donated more money than I can afford to Trump and Conservative candidates across the country.
Accuse me of being a deplorable, a chump a baby-saver and you get my tag line below. Tragically, I am no longer a Centrist - shoot looters on sight!

GraniteguyHow long will it take for the Dems to realize that ACB isn't going anywhere for a long time? They can roost on their cancel culture all they want - it isn't going to change a thing.
Organizations that fold and submit to this cancel culture (Girl Scouts and Rhodes U) are not worthy enough to congratulate ACB or even associate her name with their ilk.

Supreme Court Declines to Block New York Vaccine Mandate for Healthcare Workers
When New York’s original vaccine mandate for healthcare workers was announced, it included an exemption for religious reasons. However, when the administration changed hands, Governor Hochul removed the religious exemption. A lawsuit was filed. A federal appeals court loss brought the plaintiffs to the Supreme Court requesting an injunction.
Today, the request from the 20 plaintiffs was rejected by the Supreme Court as referred by Justice Sotomayor who covers the New York region. Justices Alito, Gorsuch, and Thomas dissented and would have provide the injunctive relief. However, Chief Justice John Roberts, Amy Coney-Barrett, and Brett Kavanaugh sided with the liberal wing and denied the request.
Thomas, Alito and Gorsuch wrote in their 14-page dissent that Governor Hochul’s record in the case “practically exudes suspicion of those who hold unpopular religious beliefs,” adding, “That alone is sufficient to render the mandate unconstitutional as applied to these applicants.”
Unfortunately, the alignment of Justices Roberts, Barrett and Kavanaugh with the left wing of the court makes future constitutional appeals around the vaccine mandate look increasingly tenuous. Justice Kavanaugh and Justice Barrett have been big disappointments.

A lot of these issues vis a vis dealing with pandemic were run up the flagpole long ago (before any of us were around.) The decisions back then came down on the side of government power to deal with these situations as it saw fit.
So now that we have a pandemic, the courts are looking back at these precedents, and are abiding by them.

I wonder if it would have decided differently if the penalty had been more than a small fine.

DaveLWhether she is successful depends on whether she follows the law, not whether she does what someone thinks she should regardless what the law says. I'm all for criticizing this decision based on the law but just saying you don't like the outcome isn't ver insightful.

Are you talking about the 1904 law in Massachusetts (which actually was a law)?

WoodmanIt's a tough job. Watchers write of her incremental approach, as "a moderate who prefers small movements in the law, not huge shifts". Personally, I see taking a lifetime commitment like hers as a sacrifice.

I haven't read the briefs so I can't debate the law - I'll weigh in once I have.
The dissent makes a compelling moral argument but the legal argument is very thin.
To be clear: I think the NY mandate is absurd, especially because it does not have a religious exemption, and there's a real question whether it violates the free exercise clause. However, none of those things are sufficient to grant a preliminary injunction.
