To be fair, both sides submit jury instructions and a lot of times, the Defense will include ALL of the lesser included offenses (at least this is the way it is in Missouri....I have learned a lot since becoming a Bailiff). I have heard several juries (after a verdict and they are dismissed) that they thought the Prosecution was fishing for any conviction when it was the Defense that submitted the lesser included charges. Sometimes the Defense strategy is IF the jury in going to convict, try to make it a lesser included charge so little to no jail/prison time.

Now New York is screwed up and Manhattan is Banana Republic Justice System. In the Trump case, the "Judge" ruled against almost all the the Defense's Jury Instructions and granted all the Prosecution's Jury Instructions. Here is how it goes in Missouri:
*Both sides submit initial Jury Instructions before Trial even starts.
*At some point during trial, after Jurors have been dismissed for the day, the Judge, Prosecution and Defense finalize Jury Instructions....which can take several hours and late into the night.
*On last day of trial (and before Jury Deliberations), the Judge reads the Jury Instructions which can number from teens to 30 or so. The Prosecution goes first in Closing Arguments, Defense goes second, and the Prosecution goes one last time (I believe it was at this point the Prosecution had a new theory on crime in Trump's trial).
*Jury goes out for Deliberations.

I haven't worked a Hung Jury yet. In two cases, the Judge gave them the Hammer Rule (try again) and in both cases they came back with a proper verdict. In a sex crimes case, the initial verdict was an "Inconsistent Verdict" due to the way the Jury Instructions were written. It was explained to the Jury and they went back out and deliberated and came back with a proper verdict.

Bad day for Bragg and it'll be an even worse day when the 34 felonies case is tossed or dismissed.

^^ THIS! A very good question...

Obviously, this is the correct and righteous verdict, but certainly a curious way to get there.
