So many dumb decisions in that video.

As the car moves forward toward the officer, why isn’t that considered attempted assault with a deadly weapon?

Probably not. Even when I was trained 30 years ago we were taught that shooting into an engine was very unlikely to stop the car. These guys in the video got it to stop running (but not stop) with fully automatic fire, but you have to get lucky with what you're hitting.

Your only reliable way to stop a car is to prevent it from rolling. Get the tires/wheels off of it, get it on its side or roof, or get it into terrain that it can't drive out of.

Driver was sentenced to 5 years in prison.

I have to admit I've seen cops do some dumb things in my life but that has to take the prize for being the dumbest.

The officer has obviously watched too many movies...I wonder how many days on the beach he got for that incident?

A 357 Sig through the window angled away from the driver would have been a message that might have worked. That in hindsight of course, at the moment the hood-surfing would have been sheer terror.

Seems like it would be difficult to immediately stop a moving car / car capable of motion.

But academically, can you force the car to stop soon by shooting the radiator, have it leak all coolant and overheat the engine? How long would it take the car to stop if so? 5 minutes? Just curious.

When I had armored cars the only thing in the engine compartment that was protected was the radiator and battery tray as taking out either of those will eventually disable you. A heavier vehicle being driven harder will heat up much faster than a lighter vehicle being driven slowly. Engines made of iron will be different than those made of aluminum. You're talking several minutes to possibly tens of minutes depending on the circumstances.

I dont think I would have imitated a hood ornament over an out of state warrant. Unless it was for homicide. He is lucky to have survived the trip!

This goat rope is the classic problem of two guys that thought the other would blink. It should have never happened.

We've had two local instances similar to the OP.

1. Officer was walking up the driver's side of a small PU, during a vehicle stop, when the driver suddenly swerved away from the curb. The officer put his hand out to push back from the truck and instinctively grabbed on.

To prevent being dragged along, he vaulted into the bed. From there he fired shots into the cab to force the driver to stop.

2. Robbery gone bad. BG-1 made a run for the getaway car parked in alley beside business. Sgt jumped on hood and fired shots into the windshield striking BG-1 in the legs and causing car to stop.

In the hospital, BG-1 insisted that a "wild redheaded troll" had jumped on his hood...granted, the Sgt had red hair,was sort of short and round, and had an overbite. You can imagine his nickname after that incident.

Both the cop & driver made stupid decisions !

Cop broke his back when he was tossed, could have easily been killed or paralyzed for life. How is it that the driver only gets 5 years? Criminal ignoring the law doing criminal things almost killing an officer.

When the 2 prisoners broke out of prison by Bonnie and Clyde were recaptured, although neither of them had a firearm or even colluded to have killed the guard, they were both convicted and executed in a short time after capture. There was less crime back then for a reason.
