Stupid on steroids. The cop went way above and beyond to be professional and polite, even going so far as to cut her a break, and her level of mental illness wouldn't even accept a positive outcome. I think I understand discretion. He didn't have to give her the speeding ticket, but in attempting to give her a break, he was going to cite her for what he admitted she was innocent--not wearing her seat belt. She could have pleaded not guilty and have the dash cam audio as perfect evidence. Year V | |||

That part I actually didn’t understand. He has discretion to issue a citation or not. Many times Officer will write for under the actual speed, but still speeding or write the lessor offense if there were multiple ones. Never heard of an officer offering to write a citation for something that DIDN’T happen. I could understand if she was speeding AND not wearing her seatbelt, writing just the seatbelt. When he signs the citation he is essentially saying “I testify I saw this person do this” and by his own admission she was wearing the seatbelt. That struck me as odd that he would essentially falsify a ticket to try and cut a break. Write for 5 over, let go with a warning, write the full speed after she failed the “attitude test”, but to offer to write bogus charge? That doesn’t seem like “discretion” to me. What say the SF LEOs? Is that a common thing? What part of "...Shall not be infringed" don't you understand??? | |||

A deputy once gave me a ticket for failure to have my license on my person. It was a $7 fine and required me to go to the courthouse and show my license to the clerk when I paid it. The alternative he explained was a $130 speeding ticket, but I could pay that by mail. I earned the speeding ticket and he handed my license back to me while he explained my options. I caught on right quick that he was giving me a break and said "I'll take bring my license to the courthouse for $7 please." I haven't been pulled over since. It'd be a shame if the everything on video age changed an officer's ability to cut people some slack. | |||

I thought I heard her say "I only make 130" when she was saying how broke she was and couldn't afford a ticket. Did I hear that correctly? EDIT: I listened again and at about 1:40 she says it. Can't live on that, totally broke. She must be great at city planning and budgeting. | |||

My son was pulled over by a NJ State Trooper for doing 75 in a 65 on a state highway. The Trooper gave him a break by instead giving him a ticket for no seat belt. 1. It saved him money. 2. He didn't receive points on his license. The Trooper was being nice, but it is also a warning that we are watching and next time it will be a ticket. Living the Dream | |||

I have only been in court a few times, but the times I have gone the judge had taken the word of the Police over the word of the accused. My guess, and this is only a guess is that the Police would then say he was both speeding and wasn't wearing a seat belt. I let him off with the lesser charge. Living the Dream | |||

I think at that point the prosecutor would bring up the speeding charge, and anything else that was observed. In this specific case, she could have been charged with the cell phone usage that she admitted to, as well as expired drivers license and expired registration. He told her he was able to verify she had it, but he still could charge her for not having it on her person at the time. Just because he didn't write the ticket at the time does not preclude charges being brought against her later. | |||
