ATF Director Cekeda has previously stated that the point of the guidance is to cover as many people as the injunction allows, and to lock that protection in so a later administration cannot casually walk it back. He also said ATF is NOT going to turn the Texas order into a nationwide, everyone-everywhere rule on its own.

The Legislature fucked us over on this by only reducing the tax to $0 instead of removing suppressors & SBRs from the NFA! It was in the Big Beautiful Bill before they amended it!

So in the North Houston area, I am seeing/hearing more and more gun shops selling suppressors via 4473. The momentum is building, with sufficient velocity it becomes harder for a future administration to roll back. Supply of suppressors appears to be a key limiting factor to even larger growth.

My next thought, and what I am hoping to see soon is the same for SBR's which also have the Zero'd tax benefit.

Hoping the promised ATF guidance addresses this point adequately.

If you boil it down, if hearing safety equipment can be sold via 4473, then a barrel shorter than an arbitrarily set barrel length of 16-inches should be as well.

I was at Academy Sports Tuesday evening picking up a G19 Gen6 , and the counter guys were excited that the "suppressor section" is now ready to start displaying/selling suppressors.

That is awful brave of them to move forward without the ATF providing any written guidance. Hopefully they are doing it as a result of direction from their attorneys.

I bought a suppressor via 4473 here in North Texas on Monday. GOA dashboard check, NICS check and pay. I was in and out in 25 minutes.

Still haven't run across an LGS here that is selling on 4473's, will have to check again with the folks at the gun range, it's where I have things shipped in.

Lots of folks doing them here on 4473.

It’s quite clear who is covered. The issue being as Para has brought up is Federal Law is to be uniform. How do those not currently covered come into the fold?

The key here is momentum on numbers. Sales numbers need to be so staggeringly high that they can’t realistically muck around with it. I can understand wanting to wait and see how things shake out, but if you like your 2A wins and you want to keep getting them, we need as many gun owners as possible to pitch in and buy suppressors now. Skip coffee and eating out for a few weeks or a month and get a $300 .22 can, I don’t care, but get something.

The reason SBR’s still require a tax stamp is because of importation regulations in/around 922R or thereabouts. Can’t recall all the details at the moment, but they’re covered by the GCA specifically. I’m guessing what will become common place is a plethora of pistol configured AR’s and the like being purchased along with stocks so you can just convert it yourself easily. I’ll be shocked if the next year’s SHOT Show offerings aren’t a ton of “just convert it yourself” would-be SBR’s with the “if you’re one of the covered parties, then it’s easy to just slap a stock on it, and if you aren’t or live somewhere it’s legal in pistol configuration but not as a short barrel rifle, then we offer it with a brace” pitch.

It would be insane if shops in FL started doing that. How much is an average suppressor? I imagine sales would be quite high given the number of gun owners here.

My LGS is a member but I also joined the GOA so I provided the card, signed a 'waiver' form and bought a suppressor on a 4473 at the same times as my (experiment) Panzer ARP9.

Pretty cool actually.

The easiest way I have found is to buy off Silencershops website. They will show you dealers in your area that will transfer off a 4473. You buy from Silencershop, they ship to that FFL, you do a 4473 and pick up your new can without even a transfer fee.

One of my local shops in Pensacola sells to GOA members on a 4473 no wait other than a NICS check. I’ve bought 2. And no sales tax through end of 2026. Bought an otter creek polonium and a HUX TI 9. Saved $400 on tax stamps and about $100 in sales tax

Got Email from another company Special Ops Tactical, they make some really nice AR-15's in the couple grand price range.

He said that if I get it through SS they will release it with a standard 4473...

WASHINGTON – The Bureau of Alcohol, Tobacco, Firearms and Explosives today released an Open Letter and Frequently Asked Questions explaining how it will treat ownership, transfer, and transportation of the National Firearms Act firearms for which Congress eliminated the making and transfer taxes in the One Big Beautiful Bill.
The guidance follows an announcement by Attorney General Todd Blanche that the Department of Justice will not appeal an August decision made by the U.S. District Court for the Northern District of Texas, which held that certain provisions of the NFA were unenforceable. In that decision, the court enjoined enforcement of those NFA provisions only for the plaintiffs in the suit; however, using the Department’s enforcement discretion, the Attorney General in his announcement made the policy decision to apply the guidance to everyone, and not only to those covered by the injunction in Silencer Shop Foundation v. ATF, No. 6:25-cv-056 (N.D. Tex.).
“The direction from the President, Congress, and the courts is clear,” said ATF Director Rob Cekada. “ATF is now following suit with our enforcement posture while continuing to ensure we remain focused where we are needed the most: combatting violent crime in American communities.”
Under ATF’s guidance, ATF will not enforce the requirements for individuals to apply and receive ATF approval before making or transferring short-barreled rifles, short-barreled shotguns, suppressors (silencers), and certain other concealable firearms known in the law as “any other weapons.” ATF also will not enforce the NFA’s registration, tax-stamp or related requirements for those covered items. The $200 tax remains in place for machine guns and destructive devices. The NFA requirements apply in full to those weapons.
The guidance does not supersede state and local laws that restrict NFA firearms. Because many state laws require individuals to register NFA firearms, ATF will continue to process NFA applications that are submitted. The guidance also does not affect the Gun Control Act’s requirement to obtain ATF approval before transporting short-barreled rifles and short-barreled shotguns in interstate commerce. Individuals may obtain that approval by filing a Form 20, whether or not the item is registered under the NFA.
Under the guidance, licensed dealers must still complete Form 4473s, run NICS background checks, keep records, and follow all other Gun Control Act requirements. Those engaged in the business are required to pay any special occupational tax. Individuals must also continue to comply with state law, which may be more restrictive.
ATF urges anyone with questions to closely read the frequently asked questions, available at atf.gov. Licensees and members of the public with questions may contact the Firearms Industry Programs Branch at FIPB@atf.gov.

What happens if someone purchases one of these items from a dealer on a 4473 and down the road decides to sell it to someone else in his home state? I don't need to go through an FFL if I sell to an individual that lives in my state.
