So this is in regards to the rumor OJ has received $20K to be in some jack wagon's film. In the civil suit many years ago, the Goldman family was awarded a ton of money from OJ so with the following assumptions, how much should the defendant pay: 1. The defendant did receive $20K. 2. It's the only money he receives for the year. Question; how much of the $$ is the defendant required to pay? ($20K is under the poverty level, regardless of who you are or were.) The Goldmans have a judgment in California. To enforce it, they have to obtain Writs of Execution for assets in California, and obtain sister state judgments in other states, after which they can obtain writs of execution in those states where they believe Simpson may have assets. They can also record Abstracts of Judgment which become a lien on all real property in the name of the judgment debtor in that county. There is no requirement that a judgment debtor pay anything voluntarily. If the creditor knows the debtor will be receiving cash, the writ can be served there, or when the amount becomes due. Very tricky! A creditor can subpoena the debtor to come to court for a debtors exam to find out what his assets are and where. Each state has an often complex set of rules about what assets are subject to execution and which are exempt. Homestead is one example of exempt property. Simpson received cash. When he got it, he folded it and put it in his pocket. Earnings refers to paycheck. A creditor can file a writ of execution with an employer and garnish wages.
