Not all of New Jersey is a Liberal Democrat. Our Senator and Assemblyman and Woman have gone to bat for our 2A rights at every bill on the subject. North Jersey and South Jersey are as near to being a separate state as it can get. RE: HANDGUN REGULATIONS, MAJOR DEVELOPMENT Dear Mr. : This update has been sent to you as a supporter of Second Amendment Rights, who our Delegation has the privilege or representing. In December, our Delegation advised you that, regretfully, anti-gun advocates in the State Legislature passed a Resolution to invalidate the State Police from adopting proposed regulations that expand the justifiable need standard for issuing a handgun carry permit to include when a person faces a “serious threat.” Rightfully, our Delegation vehemently opposed and voted against the Resolution (SCR-117/ACR-205) to protect the rights to bear arms and to self-defense that are cherished by many of our constituents. Gun owners recognize that the state’s current justifiable need standard for issuing handgun carry permits is an insult to the public’s Second Amendment rights as the process is, by design, nearly insurmountable for applicants. But just when the fight on the handgun regulations seemed lost, the Christie Administration announced the adoption of a revised regulation regarding applications for handgun carry permits. As we advised in our previous correspondence, the Christie Administration contends that the invalidation process was defective in that the Assembly didn’t properly follow constitutional requirements in that it failed to transmit the initial Resolution (SCR-101) to the Offices of the Attorney General, the Superintendent of the State Police and the Governor. According to a press release recently issued by the Administration, “The revised regulation will allow a chief of police or the Superintendent of the Division of State Police, who review handgun carry permit applications, to consider evidence of “serious threats” that are not directed specifically at an individual, but which establish more than mere generalized fears or concerns.” You can read the notice of adoption here. Immediately following the announcement, anti-gun advocates in the Legislature, who were convinced the proposed rules had been invalidated, pledged to challenge the Administration’s action. Regardless, our Delegation wholeheartedly stands by you and all law-abiding gun owners in the continuing effort to protect our Second Amendment rights.
